00 CS FOR SENATE BILL NO. 192(L&C) 01 "An Act relating to teachers and training programs in the Department of Labor and 02 Workforce Development, to the placement in the exempt service of certified teachers 03 employed by the Department of Labor and Workforce Development, to their eligibility 04 to participate in the Teachers' Retirement System of Alaska, and to the functions of the 05 Alaska Workforce Investment Board regarding the Kotzebue Technical Center and the 06 Alaska Vocational Technical Center; relating to local workforce investment areas and 07 boards; repealing the business incentive training program; and providing for an 08 effective date." 09 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 10 * Section 1. AS 14.25.220(42) is amended to read: 11 (42) "teacher" or "member" means a person eligible to participate in 12 the system and who is covered by the system, limited to

01 (A) a certificated full-time or part-time elementary or 02 secondary teacher, a certificated school nurse, or a certificated person in a 03 position requiring a teaching certificate as a condition of employment in a 04 public school of the state, [OR IN] the Department of Education and Early 05 Development, or the Department of Labor and Workforce Development; 06 (B) a full-time or part-time teacher of the University of Alaska 07 or a person occupying a full-time administrative position at the University of 08 Alaska that requires academic standing; the approval of the administrator must 09 be obtained before an administrative position qualifies for membership in the 10 system; however, a teacher or administrative person at the university who is 11 participating in the optional university retirement program under AS 14.40.661 12 - 14.40.799 is not a member under this system; 13 (C) a state legislator who elects membership under 14 AS 14.25.040(b); 15 * Sec. 2. AS 23.15.550(a) is amended to read: 16 (a) The Alaska Workforce Investment Board is established in the department. 17 The board consists of the following voting members, not to exceed 26: 18 (1) the lieutenant governor or the lieutenant governor's designee; 19 (2) the commissioners of community and economic development, 20 education and early development, health and social services, and labor and workforce 21 development, or each respective commissioner's designee; 22 (3) one representative from the University of Alaska; 23 (4) four additional representatives of education, with one from local 24 public education, one from secondary vocational education, one from a postsecondary 25 vocational education institution, and one from adult basic education; 26 (5) four representatives of business and industry [, WITH AT LEAST 27 ONE REPRESENTATIVE FROM THE LOCAL WORKFORCE INVESTMENT 28 BOARDS APPOINTED UNDER 29 U.S.C. 2832]; 29 (6) four representatives of organized labor whom [THAT] the 30 governor shall appoint from lists of nominees submitted by recognized state labor 31 organizations; the governor may reject a list submitted under this paragraph and

01 request that another list be submitted; 02 (7) at least one representative from an organization representing 03 employment and training needs of Alaska Natives; 04 (8) at least one representative of a community-based service 05 organization; 06 (9) at least one representative who has personal or professional 07 experience with developmental disabilities; and 08 (10) at least one and up to five additional members of the private 09 sector to ensure a private sector majority and regional and local representation on the 10 board. 11 * Sec. 3. AS 23.15.580(f) is amended to read: 12 (f) The following training programs are subject to the provisions of (d) and (e) 13 of this section: 14 (1) in the Department of Labor and Workforce Development or 15 operated by the department: 16 (A) programs under 29 U.S.C. 2801 - 2945 (Workforce 17 Investment Act of 1998), assisting communities in moving toward a self- 18 sustainable economy and providing training; 19 (B) state training and employment program (AS 23.15.620), 20 providing training and employment services for people who are unemployed or 21 likely to become unemployed, fostering new jobs, and increasing training 22 opportunities for workers severely affected by fluctuations in the state 23 economy or adversely affected by technology advances in the workplace; 24 (C) employment-related adult basic education; 25 (D) employment training services operated as part of the 26 Alaska temporary assistance program (ATAP); 27 (E) unemployment insurance grants provided under the federal 28 training relocation assistance program; 29 (F) Alaska works programs, assisting with the welfare-to-work 30 program; 31 (G) Kotzebue Technical Center;

01 (H) Alaska Vocational Technical Center; 02 (2) in the Department of Education and Early Development or operated 03 by the department, the non-public-school portions of the [FOLLOWING 04 PROGRAMS:] 05 (A) [KOTZEBUE TECHNICAL CENTER; 06 (B) ALASKA VOCATIONAL TECHNICAL CENTER; 07 (C)] vocational education and technical preparation program; 08 and 09 (B) [(D)] Alaska Career Information System. 10 * Sec. 4. AS 23.15.645(b) is amended to read: 11 (b) When a grant is awarded to the board, the department shall annually 12 provide to the board a priority list of targeted projects or services, based on 13 unemployment statistics, unemployment insurance claims, occupational and industrial 14 projections, availability of other training and employment programs, and other 15 relevant data. The department shall also provide annually to the board a priority list of 16 criteria for eligibility to maximize services to those people most in need of training 17 under AS 23.15.620 - 23.15.660. In developing the priority list for targeted projects 18 and services, the department shall solicit comments from the Department of Education 19 and Early Development, the Department of Community and Economic Development, 20 the University of Alaska, organized labor, and the board [, AND THE 21 ADMINISTRATIVE ENTITIES OF THE LOCAL WORKFORCE INVESTMENT 22 AREAS ESTABLISHED FOR THE BOARD]. The department shall give preference 23 to projects and services that train individuals in industries identified in the resident 24 hire report required under AS 36.10.130 as employing a disproportionate percentage 25 of nonresident individuals. 26 * Sec. 5. AS 39.25.110(7) is amended to read: 27 (7) certificated teachers employed by the Department of Education and 28 Early Development as correspondence teachers, teachers in skill centers operated by 29 the Department of Education and Early Development or by the Department of 30 Labor and Workforce Development, or in Mt. Edgecumbe School; 31 * Sec. 6. AS 23.15.651(c), 23.15.660(2), 23.15.700, 23.15.710, 23.15.720, 23.15.730,

01 23.15.740, 23.15.750, 23.15.760, 23.15.770, 23.15.780, 23.15.790, 23.15.800, and 23.15.810 02 are repealed. 03 * Sec. 7. This Act takes effect July 1, 2003.
