00 SENATE BILL NO. 76 01 "An Act making supplemental and other appropriations; amending appropriations; 02 making appropriations to capitalize funds; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. DEPARTMENT OF ADMINISTRATION. (a) The following appropriations 05 are made to the Department of Administration for the fiscal year ending June 30, 2003: 06 (1) the sum of $400,000 from the general fund to the division of finance, for 07 charge-back overruns on the state's accounting and payroll systems; 08 (2) the sum of $390,700 from the general fund to the Pioneers' Homes, for 09 increased costs for certified nurse aides and assisted living aides; 10 (3) the sum of $14,300 from federal receipts to the Alaska Oil and Gas 11 Conservation Commission, for the underground injection control program; 12 (4) the sum of $2,473,500 from the general fund to the office of public 13 advocacy, for operating costs of the office; 14 (5) the sum of $1,157,000 from the general fund to the Public Defender

(a) 17 The sum of $51,000 is appropriated from the disaster relief fund (AS 26.23.300) to the 18 commercial fishing revolving loan fund (AS 16.10.340). 19 (b) The federal receipts from the United States Department of Agriculture, 20 Community Facilities Economic Impact Initiative Grants program, authorized by RPL 08-3- 21 0104, are appropriated to the Department of Community and Economic Development, 22 Regulatory Commission of Alaska, for rural Alaska Internet access capital grants under the 23 federal grant agreement. 24 (c) The sum of $200,000 is appropriated from receipt supported services to the 25 Department of Community and Economic Development, division of insurance, for operating 26 costs for the fiscal year ending June 30, 2003. 27 (d) The sum of $115,000 is appropriated from statutory designated program receipts 28 to the Department of Community and Economic Development, international trade and market 29 development, for costs associated with the Korea USA economic conference for the fiscal 30 year ending June 30, 2003. 31 (e) Section 1, ch. 94, SLA 2002, page 7, lines 30 - 33, is amended to read:

FISH AND GAME ENFORCEMENT. Section 15, ch. 94, SLA 2002, is amended
01 to read: 02 Sec. 15. FISH AND GAME ENFORCEMENT. (a) To increase enforcement 03 of the fish and game laws of the state, an amount from the general fund equal to the 04 amount adjudged [DEPOSITED IN THE GENERAL FUND] during the fiscal year 05 ending June 30, 2002, for [FROM] criminal fines, penalties, and forfeitures 06 [IMPOSED] for violation of AS 16 and its implementing regulations and the amount 07 received from the sale of forfeited property or alternative damages collected under 08 AS 16.05.195 is appropriated to the fish and game fund (AS 16.05.100). 09 (b) Appropriations totaling the estimated amounts from the sources 10 [AMOUNT OF THE DEPOSITS] described in (a) of this section and the remaining 11 unexpended and unobligated balances from prior year transfers for these purposes are 12 made in sec. 1 of this Act to the Department of Public Safety and the Department of 13 Law for increased enforcement, investigation, and prosecution of state fish and game 14 laws. If these [THE] amounts [OF THE DEPOSITS AND UNEXPENDED AND 15 UNOBLIGATED BALANCES] fall short of the estimates appropriated in sec. 1 of 16 this Act, the amounts appropriated to the Department of Public Safety and the 17 Department of Law from the fish and game fund as set out in sec. 1 of this Act are 18 reduced proportionately. 19 * Sec. 7. FIRE SUPPRESSION. The sum of $19,033,800 is appropriated from the general 20 fund to the Department of Natural Resources for fixed operating costs and costs incurred for 21 fire suppression expenditures for the fiscal year ending June 30, 2003. 22 * Sec. 8. DEPARTMENT OF HEALTH AND SOCIAL SERVICES. (a) The following 23 appropriations are made to the Department of Health and Social Services for the fiscal year 24 ending June 30, 2003: 25 (1) the sum of $2,368,000 to adult public assistance, for additional operating 26 costs due to caseload growth, from the following sources in the amounts listed: 27 Federal receipts $ 285,000 28 General fund 2,083,000 29 (2) the sum of $450,000 from federal receipts to family preservation, for 30 increased operating costs; 31 (3) the sum of $25,800 from the general fund to the McLaughlin youth center,
01 for additional operating costs; 02 (4) the sum of $20,000 from the general fund to the Fairbanks youth facility, 03 for additional operating costs; 04 (5) the sum of $100,800 from the general fund to the Nome youth facility, for 05 additional operating costs; 06 (6) the sum of $11,500 from the general fund to the Johnson youth center, for 07 additional operating costs; 08 (7) the sum of $66,100 from the general fund to the Bethel youth facility, for 09 additional operating costs; 10 (8) the sum of $195,000 from receipt supported services to the bureau of vital 11 statistics, for additional operating costs. 12 (b) Section 1, ch. 94, SLA 2002, page 19, lines 6 and 7, is amended to read: 13 APPROPRIATION GENERAL OTHER 14 ALLOCATIONS ITEMS FUND FUNDS 15 Medical Assistance 801,298,100 172,408,400 628,889,700 16 [790,306,800] [144,352,600] [645,954,200] 17 Medicaid Services 801,298,100 18 [790,306,800] 19 (c) Section 12(c), ch. 1, SSSLA 2002 is amended to read: 20 (c) The sum of $300,000 is appropriated from the general fund to the 21 Department of Health and Social Services, Statewide Suicide Prevention Council, for 22 the fiscal years [YEAR] ending June 30, 2003, and June 30, 2004, for a follow-back 23 study seeking ways to address the causative factors contributing to suicides in Alaska. 24 It is the intent of the legislature that the Alaska Mental Health Trust Authority provide 25 $100,000 to match the appropriation made in this section. 26 (d) Section 96(d), ch. 1, SSSLA 2002 is amended to read: 27 (d) The appropriations made by secs. 10(b), 12(c), 12(d), 12(e), 14(c), 28 21(c)(1), 23, 28, 54(b), and 75(a) of this Act lapse June 30, 2004. 29 * Sec. 9. JUDGMENTS AND CLAIMS. The sum of $1,136,400 is appropriated to the 30 Department of Law to pay judgments and claims against the state for the fiscal year ending 31 June 30, 2003, from the following sources in the amounts listed:

DEPARTMENT OF REVENUE. The sum of $26,000 is appropriated from 24 general fund program receipts to the Department of Revenue, Alcoholic Beverage Control 25 Board, for operating costs for the fiscal year ending June 30, 2003. 26 * Sec. 14. DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES. (a) 27 The unexpended and unobligated balance of the toll receipts from Whittier Tunnel operations 28 received during the fiscal year that ended June 30, 2002, is appropriated to the Department of 29 Transportation and Public Facilities, central region highways and aviation, for tunnel 30 operations during the fiscal year ending June 30, 2003. 31 (b) Section 19(c), ch. 1, SSSLA 2002 is amended to read:

01 from the general fund derived from criminal fines, penalties, and forfeitures, not specifically 02 appropriated for another purpose, are ratified and appropriated to the fish and game fund 03 (AS 16.05.100) to cover the shortfall: 04 (1) sec. 14, ch. 60, SLA 2001; 05 (2) sec. 16, ch. 133, SLA 2000; 06 (3) sec. 31, ch. 135, SLA 2000; 07 (4) sec. 9, ch. 84, SLA 1999; 08 (5) sec. 9, ch. 137, SLA 1998; 09 (6) sec. 9, ch. 98, SLA 1997. 10 * Sec. 18. NONLAPSE OF APPROPRIATIONS. (a) The appropriations made by secs. 11 2(a) and 4 of this Act are to capitalize funds and do not lapse. 12 (b) The appropriations made by secs. 2(b) and 12(c) of this Act are for capital projects 13 and lapse under AS 37.25.020. 14 * Sec. 19. RETROACTIVITY. (a) Section 2(a) of this Act is retroactive to January 15, 15 2001. 16 (b) Section 11(c) of this Act is retroactive to July 1, 2002. 17 (c) Section 2(b) of this Act is retroactive to October 3, 2002. 18 * Sec. 20. The appropriations made by secs. 1, 2(c) - (f), 3 - 10, 11(a), 11(b), and 12 - 17 of 19 this Act take effect May 21, 2003. 20 * Sec. 21. Except as provided in sec. 20 of this Act, this Act takes effect immediately under 21 AS 01.10.070(c).
