00 CS FOR HOUSE BILL NO. 467(FIN) 01 "An Act establishing an Alaska Commemorative Coin Commission to develop the 02 design concepts and to make recommendations regarding the final design of the Alaska 03 quarter under the 50 States Commemorative Coin Program Act; and providing for an 04 effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 07 to read: 08 PURPOSE OF THE ACT. (a) On December 1, 1997, the United States Congress 09 enacted the 50 States Commemorative Coin Program Act, P.L. 105-124. The Act created the 10 50 State Quarters Program, a 10-year program under which a design honoring each state is 11 placed on the reverse side of the United States quarter. A quarter honoring the State of 12 Alaska is scheduled to be issued in 2008. 13 (b) As part of the selection process, the United States Secretary of the Treasury and 14 the United States Mint have requested that each state governor conduct a concept selection
01 process and provide the United States Mint with at least three, but not more than five, 02 narrative design concepts for the Alaska quarter. Based on the narrative design concepts 03 submitted by the State of Alaska, the United States Mint will produce original artwork 04 embodying each concept. A Citizens Commemorative Coin Advisory Committee and the 05 United States Commission of Fine Arts will review the designs and make recommendations. 06 After approval of the designs by the Secretary of the Treasury, the designs are to be presented 07 to the state. As provided in the 50 States Commemorative Coin Program Act, the governor 08 will then recommend the final design to the Secretary of the Treasury, with the secretary 09 having final approval. 10 (c) This Act establishes an Alaska Commemorative Coin Commission to develop the 11 narrative design concepts to be presented to the United States Mint and to make 12 recommendations to the governor regarding the final design of the Alaska quarter. 13 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 14 read: 15 ALASKA COMMEMORATIVE COIN COMMISSION. (a) The Alaska 16 Commemorative Coin Commission is established. The commission consists of 11 members, 17 determined as follows: 18 (1) the governor shall appoint 10 public members to the commission, of whom 19 (A) one member shall be appointed from a list prepared and submitted 20 by the Alaska State Council on the Arts; 21 (B) one member shall, at the time of appointment, be a student in the 22 state in a public or private secondary school or a home study secondary student in the 23 state, appointed from a list prepared and submitted by the State Board of Education 24 and Early Development; 25 (C) two members shall be residents of and be appointed from each of 26 the four judicial districts in the state; and 27 (2) the governor or the governor's designee. 28 (b) The governor shall designate the chair and vice-chair of the commission. 29 (c) If a member of the commission resigns or is otherwise unable to perform the 30 duties of a member of the commission, the governor shall appoint a replacement member as 31 soon as possible.
01 (d) Members of the commission are entitled to the expenses, travel, and per diem 02 allowances provided by law. 03 (e) A majority of the members of the commission constitutes a quorum. The 04 commission shall attempt to operate by consensus, but the commission may approve 05 measures, make recommendations, and take other action based on a vote of a majority of the 06 quorum that is present. 07 (f) The commission expires when the United States Secretary of the Treasury 08 approves the final design for the Alaska quarter. 09 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 10 read: 11 ALASKA COMMEMORATIVE COIN SELECTION PROCESS. (a) The Office of 12 the Governor shall initiate a public process to solicit narrative design concepts for the Alaska 13 quarter from the public. The solicitation must provide for submission of design concepts by a 14 date certain. The Office of the Governor may delegate the duty set out in this subsection to 15 the Alaska Commemorative Coin Commission. 16 (b) The commission shall set out a procedure for the review and consideration of all 17 narrative design concepts that it receives. By a time to be specified by the United States Mint, 18 the commission shall submit to the United States Mint not less than three, nor more than five, 19 design concepts for the Alaska quarter. The commission may edit or revise any of the 20 narratives if it chooses to do so. Each narrative must explain why the concept submitted is 21 emblematic of the State of Alaska and what the concept represents to the people of the State 22 of Alaska. 23 (c) When the United States Mint provides the State of Alaska with its final designs, 24 the commission shall reconvene to review the designs and to make final recommendations to 25 the governor for the design of the Alaska quarter. The commission's final recommendations 26 are subject to approval by the governor. 27 (d) In its deliberations under this section, the commission shall bear in mind that the 28 calendar year in which the Alaska quarter is to be issued will coincide with events leading to 29 celebration of the 50th anniversary of Alaska statehood. 30 (e) The Office of the Governor shall provide the commission with all reasonable and 31 necessary staff support, but the governor may delegate or assign this obligation to another
01 agency. 02 * Sec. 4. Sections 1 - 3 of this Act are repealed January 1, 2009. 03 * Sec. 5. This Act takes effect January 1, 2005.
