00 HOUSE BILL NO. 463 01 "An Act relating to a poll of legislators on the question of calling a special session." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 24.05.100(a)(2) is amended to read: 04 (2) The legislature may call itself into special session if two-thirds of 05 the membership responds in the affirmative to a poll conducted by the presiding 06 officer of each house. Each presiding officer may initiate a poll by their joint 07 agreement, and each shall, within three days, initiate a poll upon the request of 25 08 percent of the membership of each house, expressed in writing and signed by those 09 members. [WHEN TWO-THIRDS OF THE MEMBERSHIP TO WHICH THE 10 LEGISLATURE IS ENTITLED RESPONDS IN THE AFFIRMATIVE, THE 11 PRESIDENT OF THE SENATE AND SPEAKER OF THE HOUSE SHALL 12 JOINTLY ANNOUNCE THE RESULT OF THE POLL AND A DATE FOR THE 13 CONVENING OF THE SPECIAL SESSION.] If one of the presiding officers is 14 deceased, has resigned, or is incapacitated, the presiding officer of the other house 15 may conduct the poll of the members of both houses. Within three days after all

01 legislators have been polled, the presiding officers jointly shall publicly announce 02 the results of the poll and the vote of each legislator. When two-thirds of the 03 membership to which the legislature is entitled votes in the affirmative, the 04 presiding officers shall also announce the date for the convening of the special 05 session. The vote of each legislator cast during a poll conducted under this 06 paragraph shall be delivered by the presiding officers to the Legislative Affairs 07 Agency for inclusion in the voting record of each legislator compiled under 08 AS 24.08.105. 09 * Sec. 2. AS 24.60.030 is amended by adding a new subsection to read: 10 (i) Failure by a presiding officer to make public the results of a poll on a 11 question of calling a special session and the vote of each legislator as required under 12 AS 24.05.100(a)(2) constitutes a violation of this chapter.
