00 HOUSE BILL NO. 430 01 "An Act relating to employees under 21 years of age in the premises of hotels, 02 restaurants, and eating places that are licensed to sell, serve, deliver, or dispense 03 alcoholic beverages." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 04.16.049(c) is amended to read: 06 (c) Notwithstanding any other provision in this section, a person 16 or 17 07 [BETWEEN 16 AND 19] years of age may enter and remain within the licensed 08 premises of a hotel, restaurant, or eating place in the course of employment if (1) the 09 employment does not involve the serving, mixing, delivering, or dispensing of 10 alcoholic beverages; (2) the person has the written consent of a parent or guardian; and 11 (3) an exemption from the prohibition of AS 23.10.355 is granted by the Department 12 of Labor and Workforce Development. The board, with the approval of the governing 13 body having jurisdiction and at the licensee's request, shall designate which premises 14 are hotels, restaurants, or eating places for the purposes of this subsection.

AS 04.16.049(d) is amended to read: 02 (d) Notwithstanding any other provision in this section, a person 18, 19, or 20 03 years of age may be employed within the licensed premises of a hotel, restaurant, or 04 eating place, may enter and remain within those premises for the purpose of 05 employment, but may not in the course of employment, sell, serve, deliver, or dispense 06 alcoholic beverages.
