00 HOUSE BILL NO. 425 01 "An Act relating to funding for school districts operating secondary school boarding 02 programs, to funding for school districts from which boarding students come, and to 03 inoperative school districts; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 14.14.120 is amended by adding a new subsection to read: 06 (e) Notwithstanding (a) of this section, a district with fewer than eight children 07 eligible to attend elementary and secondary school may not be declared inoperative if 08 the district would have at least eight eligible children if each eligible child from the 09 district who is enrolled in a district secondary school boarding program outside of the 10 district and operated under AS 14.16.200 were counted as a student in the district. 11 * Sec. 2. AS 14.16 is amended by adding a new section to read: 12 Article 2. School Districts Operating Boarding Programs. 13 Sec. 14.16.200. State funding for districts operating secondary school 14 boarding programs. (a) A district that began operating a secondary school boarding

01 program before January 1, 2004, is eligible to receive reimbursement for the costs 02 incurred by the district in operating that program. To be eligible for reimbursement 03 for costs, the district secondary school boarding program must provide a suitable 04 student dormitory licensed under AS 47.35.015(h) and daily access to a public school 05 offering the appropriate grade level. 06 (b) Costs that may be claimed by a district for reimbursement under (a) of this 07 section are 08 (1) one round trip between the student's community of residence and 09 the school during the school year if the district expends money for the trip; and 10 (2) a per-pupil stipend determined by the department on a regional 11 basis. 12 (c) In this section, 13 (1) "district" has the meaning given in AS 14.17.990; 14 (2) "district secondary school boarding program" means a public 15 school operated by a district in which domiciliary services are provided for students in 16 grades nine through 12. 17 * Sec. 3. AS 14.17.905 is amended by adding a new subsection to read: 18 (c) Notwithstanding (a)(1) of this section, a community with an ADM of less 19 than 10 shall be counted as a school if the ADM would be at least 10 if each student 20 from the community who is enrolled in a district secondary school boarding program 21 outside of the student's community and operated under AS 14.16.200 were counted as 22 a student in the community. 23 * Sec. 4. AS 14.14.120(e); AS 14.16.200; and AS 14.17.905(c) are repealed July 1, 2009. 24 * Sec. 5. This Act takes effect July 1, 2004.
