00 HOUSE BILL NO. 343 01 "An Act establishing the Alaska Skilled Trade Labor Advisory Board and relating to 02 examination, application, and continued competency requirements for certain skilled 03 trade occupations; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 08.18.031(a) is amended to read: 06 (a) Except as provided in (c) and (d) of this section, a certificate of 07 registration shall be renewed under the same requirements as for an original 08 registration, and the commissioner shall issue to the applicant a certificate of 09 registration upon compliance with the registration requirements of this chapter. 10 * Sec. 2. AS 08.18.031 is amended by adding a new subsection to read: 11 (d) The department may adopt regulations under AS 44.62 after consideration 12 of the recommendations of the Alaska Skilled Trade Labor Advisory Board 13 establishing standards for continued competency of an applicant for registration 14 renewal.

01 * Sec. 3. AS 23.05 is amended by adding new sections to read: 02 Article 6. Alaska Skilled Trade Labor Advisory Board. 03 Sec. 23.05.400. Alaska Skilled Trade Labor Advisory Board. (a) There is 04 established within the Department of Labor and Workforce Development the Alaska 05 Skilled Trade Labor Advisory Board. The board is made up of not more than 10 06 members appointed by the governor. Members are appointed for staggered terms of 07 four years in accordance with AS 39.05.055. A vacancy in an unexpired term shall be 08 filled by appointment by the governor for the remainder of the term. The board must 09 include two members who each have a working knowledge in at least one area of 10 skilled trade labor and are licensed or registered under AS 08.18, one of whom is a 11 member of organized labor and one of whom is from an independent labor pool. One 12 member shall be a licensed electrical or mechanical administrator under AS 08.40. 13 One member shall be certified under AS 18.62. Not more than two members may be 14 registered general contractors under AS 08.18. 15 (b) The governor may remove a member of the board only for cause, including 16 incompetence, neglect of duty, misconduct in office, poor attendance, or nonfeasance 17 of duty. 18 (c) Members of the board receive no compensation for their services but are 19 entitled to per diem and travel expenses authorized for boards and commissions under 20 AS 39.20.180. 21 (d) The board shall designate a chair from among the members of the board. 22 The designated member serves as chair at the pleasure of the board. 23 Sec. 23.05.410. Powers and duties of the Alaska Skilled Trade Labor 24 Advisory Board. (a) The board shall 25 (1) establish its own rules of procedure; 26 (2) hold regular meetings by teleconference in compliance with 27 AS 44.62.310; 28 (3) by December 30 of each year, prepare and submit to the governor a 29 report on developments and changes in the skilled trade labor industry during the 30 calendar year that may affect the public, individuals, or organizations within the 31 industry and make recommendations for legislative action; the board shall notify the

01 legislature that the report is available; 02 (4) gather information, hold public hearings, and draft proposed 03 regulations relating to registration or license examination, issuance, and renewal and 04 to continued competency standards of skilled trade laborers for consideration by the 05 Department of Community and Economic Development under AS 08.18.031, 06 AS 08.40.050, and 08.40.135; 07 (5) consider the advice of and provide recommendations to the Alaska 08 Workforce Investment Board established by AS 23.15.550 on issues relating to initial 09 training and vocational education; 10 (6) gather information and make recommendations to the Department 11 of Community and Economic Development relating to the development of further 12 reciprocity opportunities in the state; 13 (7) review all reasonably available relevant continuing education and 14 competency course materials and advise the department regarding the use of such 15 materials in the state; 16 (8) gather information, hold public hearings, and draft proposed 17 regulations relating to certification and renewal of applicants under AS 18.62 for 18 consideration by the Department of Health and Social Services. 19 (b) The board may hold meetings in person upon approval of the department. 20 Sec. 23.05.500. Definitions. In this chapter, 21 (1) "board" means the Alaska Skilled Trade Labor Advisory Board; 22 (2) "skilled trade labor" means an activity that is required by law to be 23 performed by a person registered, certified, or licensed under AS 08.18, AS 08.40, or 24 AS 18.62. 25 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
