00 HOUSE BILL NO. 215 01 "An Act repealing statutes that relate to art works in public buildings and facilities and 02 that require a set percentage of construction costs to be spent on art." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 44.27.050 is amended to read: 05 Sec. 44.27.050. Duties of council. The duties of the council are 06 (1) to stimulate and encourage throughout the state the study and 07 presentation of the performing, visual, and fine arts and public interest and 08 participation; 09 (2) to make surveys, which are considered advisable, of public and 10 private institutions engaged in the state in artistic and cultural activities, including but 11 not limited to music, theatre, dance, painting, sculpture, architecture, and allied arts 12 and crafts, and to make recommendations concerning appropriate methods to 13 encourage participation in and appreciation of the arts to meet the legitimate needs and 14 aspirations of persons in all parts of the state;

01 (3) to take steps necessary and appropriate to encourage public interest 02 in the cultural heritage of the state and to expand the state's cultural resources; 03 (4) to encourage and assist freedom of artistic expression essential for 04 the well-being [WELL BEING] of the arts; and 05 (5) [TO MANAGE THE ART IN PUBLIC PLACES FUND; 06 (6)] to administer the provisions of AS 45.65 relating to the 07 identification seal for authentic Native handicrafts made in the state and adopt 08 regulations to carry out those provisions. 09 * Sec. 2. AS 44.27.052(a) is amended to read: 10 (a) The council may 11 (1) hold public and private hearings; 12 (2) enter into contracts, within the limit of funds available, with 13 individuals, organizations, and institutions for services furthering the educational 14 objectives of the council's programs; 15 (3) enter into contracts, within the limit of funds available, with local 16 and regional associations for cooperative endeavors furthering the educational 17 objectives of the council's programs; 18 (4) accept gifts, contributions, and bequests of unrestricted funds from 19 individuals, foundations, corporations, and other organizations or institutions for the 20 purpose of furthering the educational objectives of the council's programs; and 21 (5) make and sign agreements and do and perform any acts necessary 22 to carry out the purposes of AS 44.27.040 - 44.27.058 [AS 44.27.040 - 44.27.060]. 23 * Sec. 3. AS 44.35.030 is amended to read: 24 Sec. 44.35.030. Construction of memorials to Alaska veterans. The 25 Department of Military and Veterans' Affairs may construct memorials to Alaska 26 veterans. A memorial constructed under this section is not subject to AS 35.15 [OR 27 AS 35.27]. 28 * Sec. 4. AS 35.27.010, 35.27.020, 35.27.030; and AS 44.27.060 are repealed. 29 * Sec. 5. The uncodified law of the State of Alaska is amended by adding a new section to 30 read: 31 WINDING-UP PROVISION. The Alaska State Council on the Arts shall continue to

01 manage the art in public places fund created under former AS 44.27.060(a), repealed by sec. 4 02 of this Act, for the purposes specified in former AS 44.27.060(c), repealed by sec. 4 of this 03 Act, until the balance of the fund is exhausted.
