00 HOUSE BILL NO. 72 01 "An Act relating to the qualifications and appointment of members of the Board of 02 Regents of the University of Alaska; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 05 to read: 06 INTENT. It is the intent of this Act 07 (1) to add one nonvoting student advisory member to the existing Board of 08 Regents of the University of Alaska; and 09 (2) that, by creating a cycle of the new member's first acting for one year as a 10 nonvoting student member of the board and then acting as a voting member, the student body 11 and the Board of Regents of the University of Alaska will obtain better qualified student 12 regents and avoid vacancies in the student membership on the board. 13 * Sec. 2. AS 14.40.120 is amended to read: 14 Sec. 14.40.120. University governed by Board of Regents. The University

01 of Alaska shall be governed by a Board of Regents consisting of 11 voting regents 02 and one nonvoting advisory student regent. 03 * Sec. 3. AS 14.40.130(a) is amended to read: 04 (a) Each regent shall be a citizen of the United States and a resident of the 05 state. At least one regent shall have received an undergraduate or graduate 06 degree from the University of Alaska. 07 * Sec. 4. AS 14.40.130(b) is amended to read: 08 (b) In addition to satisfying the requirements of (a) of this section, a [THE] 09 regent appointed under AS 14.40.150(b) must 10 (1) be enrolled as a full-time student at the University of Alaska at the 11 time of appointment; 12 (2) remain a full-time student while serving. 13 * Sec. 5. AS 14.40.130(c) is amended to read: 14 (c) Failure of a [THE] regent appointed under AS 14.40.150(b) to remain 15 enrolled as a full-time student at the University of Alaska during the term for which 16 the regent was appointed results in forfeiture of that office. 17 * Sec. 6. AS 14.40.150(b) is amended to read: 18 (b) The governor shall appoint two students as members of the Board of 19 Regents. The student who has the longer service as a student regent shall be a 20 voting member of the board and the second student regent shall be a nonvoting 21 student member. A student serving as a nonvoting student regent may vote in 22 subcommittees of the Board of Regents [AT LEAST ONE MEMBER OF THE 23 BOARD OF REGENTS MUST BE A STUDENT]. Each [THE] student shall be 24 appointed from a list of nominees submitted to the governor. The governor shall make 25 the appointment from the list within 60 days after it is submitted. The list must 26 [SHALL] consist of the names of two students from each campus of the University of 27 Alaska after an election is held at each campus. Elections shall be conducted under 28 rules established by the Office of the Governor. The term of office of a [THE] regent 29 appointed from the general student body, University of Alaska, is for two years. Each 30 [THE] term of office begins June 1 of the year in which the appointment is made. An 31 appointment made under AS 14.40.130(d) shall be for the unexpired term of the

01 original appointee. The voting or nonvoting status of a person appointed under 02 AS 14.40.130(d) is determined by the relative periods of service of the two student 03 regents, not by the status of the original appointee. The term "campus" used in this 04 subsection means a portion of the University of Alaska designated as a "campus" by 05 the Board of Regents. 06 * Sec. 7. The uncodified law of the State of Alaska is amended by adding a new section to 07 read: 08 TRANSITION. Notwithstanding AS 14.40.130(a) and 14.40.150(b), as amended by 09 this Act, persons holding positions on the Board of Regents on the effective date of this Act 10 may serve the remainder of their terms; except for an appointment of the second student 11 regent as required by AS 14.40.150(b), as amended in sec. 6 of this Act, a person who meets 12 the qualifications of AS 14.40.130(a) or 14.40.150(b), as amended by this Act, shall be 13 appointed when a vacancy occurs on the Board of Regents. 14 * Sec. 8. This Act takes effect June 1, 2004.
