01 Proposing amendments to the Constitution of the State of Alaska relating to the budget                                  
02 reserve fund.                                                                                                           
03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1.  Article IX, sec. 17(b), Constitution of the State of Alaska, is amended to read:                     
05            (b)  If the amount available for appropriation for a fiscal year is not sufficient                       
06       to fully fund the amount appropriated for that year [LESS THAN THE AMOUNT                                     
07       APPROPRIATED FOR THE PREVIOUS FISCAL YEAR], an appropriation may be                                               
08       made from the budget reserve fund and used to fund appropriations from the                                    
09       unrestricted general fund.  However, the amount appropriated from the fund under                              
10       this subsection may not exceed the amount necessary, when added to other funds                                    
11       available for appropriation, to provide for total funding [APPROPRIATIONS] equal                              
12       to the amount of appropriations made [IN THE PREVIOUS CALENDAR YEAR] for                                          
13       the previous fiscal year.  For purposes of applying this subsection, money from the                           
14       following sources may not be considered as available for appropriation or as                                  
15       appropriated: (1) the federal government; (2) income of the permanent fund; or                                
16       (3) this budget reserve fund.  For purposes of this subsection, "unrestricted                                 

01       general fund" shall be defined by law.                                                                        
02    * Sec. 2.  Article IX, sec. 17(d), Constitution of the State of Alaska, is repealed.                               
03    * Sec. 3.  The amendments proposed by this resolution shall be placed before the voters of                         
04 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the                        
05 State of Alaska, and the election laws of the state.
