00 SENATE BILL NO. 282 01 "An Act relating to the membership of the board of directors of the Alaska Seafood 02 Marketing Institute; extending the termination dates of certain activities and salmon 03 marketing programs of the Alaska Seafood Marketing Institute and of the salmon 04 marketing tax; and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 16.51.020(a) is amended to read: 07 (a) The governing body of the institute is a board of directors. The board 08 consists of 13 [25] voting members appointed by the governor. In making 09 appointments to the board, the governor shall consider, but need not appoint, nominees 10 presented by persons engaged in fish processing, the financing of fish processing, or 11 commercial fishing. 12 * Sec. 2. AS 16.51.020(b) is amended to read: 13 (b) Six [TWELVE] members of the board shall be seafood processors: four 14 [EIGHT] of the seafood processors must have an annual payroll in the state of more

01 than $2,500,000; two [FOUR] of the seafood processors must have an annual payroll 02 in the state of $50,000 - $2,500,000. Six [TWELVE] members of the board must be 03 engaged in commercial fishing. The governor, to the extent practicable, shall appoint 04 as commercial fishing members of the board persons engaged in commercial fishing in 05 a fishery management region of the state in the same proportion that the region 06 contributes, or is expected to contribute during the next year, to the total salmon 07 marketing tax collected under AS 43.76.110 - 43.76.130. One member of the board 08 shall be a lay person selected by the governor. 09 * Sec. 3. AS 16.51.050 is amended to read: 10 Sec. 16.51.050. Quorum. Seven [FOURTEEN] members of the board 11 appointed under AS 16.51.020 constitute a quorum for the transaction of business and 12 the exercise of the powers and duties of the board. 13 * Sec. 4. The uncodified law of the State of Alaska enacted in sec. 9, ch. 55, SLA 1993, as 14 amended by sec. 1, ch. 111, SLA 1998, is amended to read: 15 Sec. 9. AS 43.76.110, 43.76.120, and 43.76.130 are repealed June 30, 2008 16 [2003]. 17 * Sec. 5. The uncodified law of the State of Alaska enacted in sec. 10, ch. 55, SLA 1993, as 18 amended by sec. 2, ch. 111, SLA 1998, is amended to read: 19 Sec. 10. AS 16.51.100(7), 16.51.100(8), and 16.51.100(9) are repealed 20 June 30, 2009 [2004]. 21 * Sec. 6. The uncodified law of the State of Alaska is amended by adding a new section to 22 read: 23 TRANSITION; REDUCTION IN THE NUMBER OF SEAFOOD PROCESSOR 24 MEMBERS OF THE BOARD OF DIRECTORS OF THE ALASKA SEAFOOD 25 MARKETING INSTITUTE. (a) Notwithstanding AS 16.51.020, as amended by secs. 1 and 26 2 of this Act, the seafood processor members of the board of directors of the Alaska Seafood 27 Marketing Institute that are serving on the board on the effective date of this Act shall 28 continue to serve on the board for the remainder of the terms to which they were appointed. 29 (b) In the event of a vacancy in a membership of a seafood processor member of the 30 board described in (a) of this section, before the expiration of the member's term, the governor 31 shall appoint a person to serve for the balance of the term. The vacancy shall be filled in the

01 same manner as the original appointment but only for the unexpired term. 02 (c) The governor shall appoint one person eligible to serve as a large seafood 03 processor member of the board of directors of the Alaska Seafood Marketing Institute under 04 AS 16.51.020(b), as amended by sec. 2 of this Act, to fill the vacancy arising on July 1, 2003, 05 as the result of the expiration of the term of a large seafood processor member of the board. 06 (d) The governor shall appoint one person eligible to serve as a small seafood 07 processor member of the board of directors of the Alaska Seafood Marketing Institute under 08 AS 16.51.020(b), as amended by sec. 2 of this Act, to fill the vacancy arising on or about 09 July 1, 2003, as the result of the expiration of the terms of two small seafood processor 10 members of the board. 11 (e) The governor shall appoint one person eligible to serve as a large seafood 12 processor member of the board of directors of the Alaska Seafood Marketing Institute under 13 AS 16.51.020(b), as amended by sec. 2 of this Act, to fill a vacancy arising on or about July 1, 14 2004, as the result of the expiration of the terms of three large seafood processor members of 15 the board. 16 (f) The governor shall appoint one person eligible to serve as a small seafood 17 processor member of the board of directors of the Alaska Seafood Marketing Institute under 18 AS 16.51.020(b), as amended by sec. 2 of this Act, to fill the vacancy arising on or about 19 July 1, 2004, as the result of the expiration of the terms of two small seafood processor 20 members of the board. 21 (g) The governor shall appoint two persons eligible to serve as large seafood 22 processor members of the board of directors of the Alaska Seafood Marketing Institute under 23 AS 16.51.020(b), as amended by sec. 2 of this Act, to fill the vacancies arising on or about 24 July 1, 2005, as the result of the expiration of the terms of four large seafood processor 25 members of the board. 26 * Sec. 7. The uncodified law of the State of Alaska is amended by adding a new section to 27 read: 28 TRANSITION; REDUCTION IN THE NUMBER OF COMMERCIAL FISHING 29 MEMBERS OF THE BOARD OF DIRECTORS OF THE ALASKA SEAFOOD 30 MARKETING INSTITUTE. (a) Notwithstanding AS 16.51.020, as amended by secs. 1 and 31 2 of this Act, the commercial fishing members of the board of directors of the Alaska Seafood

01 Marketing Institute that are serving on the board on the effective date of this Act shall 02 continue to serve on the board for the remainder of the terms to which they were appointed. 03 (b) In the event of a vacancy in a membership of a commercial fishing member of the 04 board described in (a) of this section, before the expiration of the member's term, the governor 05 shall appoint a person to serve for the balance of the term. The vacancy shall be filled in the 06 same manner as the original appointment but only for the unexpired term. 07 (c) The governor shall appoint two persons eligible to serve as commercial fishing 08 members of the board of directors of the Alaska Seafood Marketing Institute under 09 AS 16.51.020(b), as amended by sec. 2 of this Act, to fill the vacancies arising on or about 10 July 1, 2003, as the result of the expiration of the terms of three commercial fishing members 11 of the board. 12 (d) The governor shall appoint two persons eligible to serve as commercial fishing 13 members of the board of directors of the Alaska Seafood Marketing Institute under 14 AS 16.51.020(b), as amended by sec. 2 of this Act, to fill the vacancies arising on or about 15 July 1, 2004, as the result of the expiration of the terms of four commercial fishing members 16 of the board. 17 (e) The governor shall appoint two persons eligible to serve as commercial fishing 18 members of the board of directors of the Alaska Seafood Marketing Institute under 19 AS 16.51.020(b), as amended by sec. 2 of this Act, to fill the vacancies arising on or about 20 July 1, 2005, as the result of the expiration of the terms of five commercial fishing members 21 of the board. 22 * Sec. 8. The uncodified law of the State of Alaska is amended by adding a new section to 23 read: 24 TRANSITION; QUORUM OF THE BOARD OF DIRECTORS OF THE ALASKA 25 SEAFOOD MARKETING INSTITUTE. Notwithstanding AS 16.51.050, as amended by sec. 26 3 of this Act, the quorum of the board of directors of the Alaska Seafood Marketing Institute 27 is 28 (1) 14 members until July 1, 2003; 29 (2) 12 members on July 1, 2003, until July 1, 2004; 30 (3) 10 members on July 1, 2004, until July 1, 2005; 31 (4) seven members on or after July 1, 2005.
