00 SENATE BILL NO. 226 01 "An Act relating to the statewide transportation improvement program; and providing 02 for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 19.20 is amended by adding a new section to read: 05 Sec. 19.20.100. Municipal participation in transportation projects. The 06 department may enter into agreements with municipalities for joint funding of 07 transportation projects eligible for inclusion in the statewide transportation 08 improvement program under AS 44.42.090. A municipality must agree to fund at 09 least 50 percent of the eligible cost of a transportation project that is included in the 10 municipal participation projects subcategory of the community transportation program 11 category of the statewide transportation improvement program. 12 * Sec. 2. AS 44.42 is amended by adding a new section to read: 13 Sec. 44.42.090. Statewide transportation improvement program. (a) The 14 department shall prepare a statewide transportation improvement program that

01 includes the following transportation categories: national highway system, trails and 02 recreational access to Alaska projects, and community transportation program. The 03 program shall be prepared and revised as frequently as necessary for state participation 04 in federal highway, transit, and transportation programs or, in the absence of a federal 05 requirement, at least every five years. The program must include a priority list of 06 transportation projects in each transportation category to be carried out in each year of 07 the program. The department shall adopt by regulation criteria to evaluate and rank 08 proposed transportation projects in each category in accordance with the process and 09 standards established by this section. 10 (b) The community transportation program category consists of those projects 11 within one of the following subcategories: rural and urban streets and roads, remote 12 roads and trails, transit projects, Alaska marine highway system, substandard 13 secondary roads, public health access roads, and municipal participation projects. The 14 department may not include a project in the community transportation program 15 category if the project may be included under the national highway system category or 16 the trails and recreational access to Alaska projects category. 17 (c) For purposes of preparing the statewide transportation improvement 18 program, the department shall allocate at least 60 percent of the funding anticipated to 19 be received each year for the community transportation program category to eligible 20 transportation projects in the rural and urban streets and roads subcategory. The rural 21 and urban streets and roads subcategory includes projects on streets and roads on the 22 contiguous road system in the state or connected to the Alaska marine highway system 23 or on other streets and roads identified by the department. Of the funding that is 24 allocated to projects in the rural and urban streets and roads subcategory, the 25 department shall allocate at least the following proportion of the funding to projects 26 within each borough or unified municipality with a population of 50,000 or more: 27 P = (POPm / POPs) x .75 28 Where 29 (1) P is the minimum proportion of funds allocated to transportation 30 projects in the rural and urban streets and roads subcategory that shall be allocated to 31 projects within the borough or unified municipality;

01 (2) POPm is the population of the borough or unified municipality; 02 (3) POPs is the population of the state. 03 (d) For purposes of preparing the statewide transportation improvement 04 program, the department shall allocate at least five percent of the funding anticipated 05 to be received each year for the community transportation program category to eligible 06 transportation projects in the substandard secondary roads subcategory. A substandard 07 secondary road is a dirt or gravel road or a road that has received a cold asphaltic 08 application and that 09 (1) is used by automotive equipment; 10 (2) is dedicated to public use; 11 (3) is under the control of the department; 12 (4) is not part of the national highway system or the trails and 13 recreational access to Alaska projects program; and 14 (5) does not meet standards established by the department for 15 secondary roads. 16 (e) For purposes of preparing the statewide transportation improvement 17 program, the department may allocate not more than five percent of the funding 18 anticipated to be received each year for the community transportation program 19 category to eligible transportation projects in the public health access roads 20 subcategory. Public health access roads are roads that provide access to a municipal 21 or public landfill, solid waste facility, sewage treatment plant, water source, water 22 treatment facility, or similar facility. 23 (f) For purposes of preparing the statewide transportation improvement 24 program, the department shall allocate at least 10 percent of the funding anticipated to 25 be received each year for the community transportation program category to eligible 26 transportation projects in the municipal participation projects subcategory. A 27 municipal participation project is a transportation project eligible for inclusion in the 28 community transportation program category for which a municipality has entered into 29 an agreement with the department under AS 19.20.100 to at least match the funding 30 that is provided for the project from federal and state sources. 31 (g) For purposes of preparing the statewide transportation improvement

01 program, the department shall allocate at least the following proportion of the funding 02 anticipated to be received for the trails and recreational access to Alaska projects 03 category to eligible transportation projects within each borough or unified 04 municipality with a population of 50,000 or more: 05 P = (POPm / POPs) x .75 06 Where 07 (1) P is the minimum proportion of funds allocated to transportation 08 projects in the trails and recreational access to Alaska projects category that shall be 09 allocated to projects within the borough or unified municipality; 10 (2) POPm is the population of the borough or unified municipality; 11 (3) POPs is the population of the state. 12 (h) For purposes of (c) and (g) of this section, the population of a borough 13 includes the population of cities within the borough, and transportation projects in a 14 city within a borough are projects within the borough. The department shall determine 15 the population of the state and of a borough or unified municipality in accordance with 16 procedures established by the department. 17 (i) The expenditure of funds for a transportation project proposed by the 18 department in the statewide transportation improvement program under this section is 19 subject to the prior approval of the project by the legislature through the appropriation 20 of the necessary funds. An appropriation for a transportation project proposed by the 21 department in the statewide transportation improvement program lapses into the 22 sources from which the appropriation is made on the fifth anniversary of the effective 23 date of the appropriation unless extended by law. 24 * Sec. 3. This Act takes effect July 1, 2001.
