00 SENATE BILL NO. 201 01 "An Act providing an exemption from licensure under the nurse licensure statutes; and 02 providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 08.68.400(a) is amended to read: 05 (a) This chapter does not apply to 06 (1) a qualified nurse licensed in another state employed by the United 07 States Government or a bureau, [OR] agency, or division of the United States 08 Government while in the discharge of official duties; 09 (2) nursing service given temporarily in the event of a public 10 emergency, epidemic, or disaster; 11 (3) the practice of nursing by a student enrolled in a nursing education 12 program accredited by the board when the practice is in connection with the student's 13 course of study; 14 (4) the practice of nursing by an individual enrolled in an approved

01 program or course of study approved by the board to satisfy the requirements of 02 AS 08.68.251; 03 (5) the practice of nursing by a nurse licensed in another state who 04 engages in nursing education or nursing consultation activities [,] if these activities 05 and contact with clients do not exceed 20 working days within a licensing period; 06 [OR] 07 (6) the practice of nursing by a nurse licensed in another state whose 08 employment responsibilities include transporting patients into, out of, or through this 09 state; however, this exception is valid for a period not to exceed 48 hours for each 10 transport; or 11 (7) a person who provides nonmedical care for an illness or injury 12 if 13 (A) the person is an established or accredited practitioner 14 of a recognized church or religious denomination whose adherents rely 15 exclusively on treatment of illnesses and injuries through spiritual means; 16 (B) the care is provided to an adherent of those tenets and 17 practices who is relying solely on spiritual means for healing or care; and 18 (C) the person does not otherwise practice practical or 19 registered nursing or hold out to be engaged in or licensed to engage in 20 practical nursing or registered nursing. 21 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
