00 SENATE BILL NO. 47 01 "An Act relating to credited service under the teachers' retirement system for former 02 employment as a noncertificated school nurse." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.25.107 is amended by adding a new subsection to read: 05 (b) A member who is employed as a certificated school nurse and who earned 06 credited service in the public employees' retirement system under AS 39.35 before 07 June 30, 1990, as a noncertificated school nurse may elect to receive credit under this 08 system for the credited service earned under AS 39.35 before June 30, 1990, as a 09 noncertificated school nurse. Credited service received under this subsection counts 10 as membership service in this system for all purposes. For purposes of establishing a 11 member's initial date of membership in the system, a member who has claimed 12 credited service in this system under this subsection shall be considered to have been 13 employed in this system during all of the periods for which credited service under this 14 subsection has been claimed. Receipt of credited service in this system under this

01 subsection extinguishes all rights to benefits under AS 39.35 (public employees' 02 retirement system) based on the credited service claimed. Sick leave earned while 03 employed as a noncertificated school nurse in the public employees' retirement system 04 during periods for which credited service has been claimed in this system under this 05 subsection counts as sick leave under AS 14.25.115. The administrator of the public 06 employees' retirement system shall transfer from that system to this system an amount 07 equal to the employee contributions made by the noncertificated school nurse, interest 08 earned on those contributions, and an amount that represents the employer 09 contributions and interest earned on those contributions for that service, less a 10 reasonable administrative fee. To receive credited service for employment in the 11 public employees' retirement system as a noncertificated school nurse under this 12 subsection, the member shall apply on a form provided by the administrator. When 13 application has been made, an indebtedness shall be established. The amount of the 14 indebtedness is equal to the full actuarial cost of providing benefits based on the 15 increased credited service received in this system less the amount transferred from the 16 public employees' retirement system under this subsection.
