00 SPONSOR SUBSTITUTE FOR HOUSE JOINT RESOLUTION NO. 36 01 Proposing an amendment to the Constitution of the State of Alaska relating to limiting 02 the rate of state individual income taxes and sales taxes. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. Article IX, Constitution of the State of Alaska, is amended by adding a new 05 section to read: 06 Section 18. Tax Caps. (a) The rate of an individual income tax levied by the 07 State may not exceed five percent of federal adjusted gross income, as that term is 08 defined in federal tax law. If the individual income tax is levied on any basis other 09 than federal adjusted gross income, the total amount of tax collected statewide may 10 not exceed what would have been collected if the tax rate had been five percent of 11 federal adjusted gross income. 12 (b) The rate of a sales tax levied by the State may not exceed five percent of 13 the sale price. This subsection does not limit the rate of a sales tax levied by a 14 municipality. 15 * Sec. 2. The amendment proposed by this resolution shall be placed before the voters of 16 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the
