00 HOUSE BILL NO. 508 01 "An Act relating to publication of results of testing for paralytic shellfish poisoning by 02 the Department of Environmental Conservation and to participation of the Department 03 of Environmental Conservation in the development of operating plans of qualified 04 regional dive fishery associations." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 17.20.005 is amended by adding a new subsection to read: 07 (b) The commissioner shall promptly distribute the results of testing for 08 paralytic shellfish poison conducted by, or on behalf of, the department to the public 09 by means of the official internet web site of the department. 10 * Sec. 2. AS 43.76.200(b) is amended to read: 11 (b) The Department of Fish and Game shall develop an annual operating plan 12 with the cooperation of the regional dive fishery development association and the 13 Department of Environmental Conservation on or before a date specified by the 14 Department of Fish and Game. The qualified regional dive fishery development

01 association and the Department of Environmental Conservation shall cooperate 02 with the Department of Fish and Game in the development of the annual operating 03 plan. The annual operating plan must describe the activities for which the funding will 04 be expended, including identification of species and areas for which bioassessment 05 surveys will be conducted, a description of management and research activities to be 06 performed, planning for dive fisheries, and administrative activities of the association. 07 Funds appropriated to the Department of Fish and Game for funding of qualified 08 regional dive fishery development associations may not be disbursed by the 09 department or expended by the association, except for administration of the 10 association, unless the annual operating plan has been approved by the association and 11 the Department of Fish and Game. If an annual operating plan has not been approved 12 by the association and the Department of Fish and Game, the Department of Fish and 13 Game may not disburse and the association may not expend funds received from the 14 department for administration of the association in an amount that exceeds the amount 15 of administrative expenses authorized under the annual operating plan for the prior 16 fiscal year.
