00 HOUSE BILL NO. 480 01 "An Act providing that the death of a state employee killed because of their job status 02 off the job site shall be considered an occupational death for purposes of survivor's 03 pension benefits." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 39.35.430 is amended by adding a new subsection to read: 06 (g) If an employee's death is caused by an act of assault, assassination, or 07 terrorism directly related to the employee's status as a state employee, whether the act 08 occurs on or off the job site, the death shall be considered to have occurred in the 09 performance of and within the scope of the employee's duties for purposes of (b)(2) of 10 this section. If the expressed or apparent motive and intent of the perpetrator of the 11 harm inflicted upon the employee was due to the performance of the employee's job 12 duties or employment by the state, the death shall be considered to be directly related 13 to the employee's status as a state employee.
