00 HOUSE BILL NO. 472 01 "An Act relating to persons who buy and sell secondhand articles and to certain persons 02 who lend money on secondhand articles." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 08.76.010 is amended to read: 05 Sec. 08.76.010. Transactions to be entered in book kept at place of 06 business. A person engaged in the business of buying and selling secondhand articles, 07 or lending money on secondhand articles, except a bank, shall maintain a book, in 08 permanent form, in which the person shall enter, in legible English at the time of each 09 loan, purchase, or sale, 10 (1) the date of the transaction; 11 (2) the name of the person conducting the transaction; 12 (3) the name [, AGE] and address of the customer and a physical 13 description of the customer, including age, height, weight, race, color of hair, and 14 color of eyes;

01 (4) a description of the property bought or received in pledge, which 02 includes for any firearm, watch, camera, or optical equipment bought or received in 03 pledge, the name of the maker, the serial, model, or other number, and all letters and 04 marks inscribed; 05 (5) the price paid or amount loaned; 06 (6) the signature of the customer and a notation by the person 07 conducting the transaction naming the type of identification card used to identify 08 the customer under (b) of this section and giving the number of the card; and 09 (7) the name and address of each person to whom property bought 10 or received in pledge is conveyed, and a description of the property conveyed. 11 * Sec. 2. AS 08.76.010 is amended by adding a new subsection to read: 12 (b) The person actually conducting the transaction for which a signature is 13 required under (a)(6) of this section shall verify the identity of the customer by 14 comparing the signature of the customer with the signature on a driver's license, state 15 identification card, or other identification card issued by a governmental entity to the 16 customer. 17 * Sec. 3. AS 08.76 is amended by adding a new section to read: 18 Sec. 08.76.025. Reports to peace officers. (a) A person engaged in the 19 business of buying and selling secondhand articles or lending money on secondhand 20 articles and required to maintain a book under AS 08.76.010 shall provide a weekly 21 report to 22 (1) the police department of the municipality where the person's 23 business is located; or 24 (2) the state troopers if the person's business is not located in a 25 municipality. 26 (b) The report required by (a) of this section must summarize all transactions 27 of the business during the previous week for which the information under 28 AS 08.76.010 is required and be on a form provided by, or in a format acceptable to, 29 the police department or the state troopers. 30 * Sec. 4. AS 08.76.030 is amended to read: 31 Sec. 08.76.030. Criminal liability. A person who knowingly violates

01 AS 08.76.010, [OR] 08.76.020, or 08.76.025 is guilty of a class A misdemeanor 02 [AND UPON CONVICTION IS PUNISHABLE BY A FINE OF NOT MORE THAN 03 $500, OR BY IMPRISONMENT FOR NOT MORE THAN SIX MONTHS, OR BY 04 BOTH]. 05 * Sec. 5. AS 08.76.030 is amended by adding a new subsection to read: 06 (b) In this section, "knowingly" has the meaning given in AS 11.81.900.
