00 HOUSE BILL NO. 445 01 "An Act allowing peace officers with previous service as fish and wildlife enforcement 02 officers in the Department of Public Safety to claim credit for service as peace officer 03 service; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 39.35.370 is amended by adding a new subsection to read: 06 (i) A member who is vested in the system as a peace officer may convert the 07 person's credited service as an employee of the Department of Public Safety for 08 credited service as a fish and wildlife enforcement officer earned on or after June 23, 09 1983, and before July 1, 1995, to credited service as a peace officer by claiming the 10 service as peace officer service. When the member claims this credited service as 11 peace officer service, an indebtedness of the member to the system shall be 12 established. The indebtedness is equal to the full actuarial cost of the conversion of 13 the credited service to treatment as peace officer service. Any outstanding 14 indebtedness that exists at the time the member is appointed to retirement will require

01 an actuarial adjustment to the benefits payable based upon the conversion of the 02 credited service. In this subsection, "fish and wildlife enforcement officer" means a 03 person performing service in the specific job class identified as "fish and wildlife 04 enforcement officer" that existed in the Department of Public Safety, division of state 05 troopers, fish and wildlife protection, from fiscal year 1983 to fiscal year 1995. 06 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 07 read: 08 The provisions of AS 39.35.370(i), added by sec. 1 of this Act, may not be applied to 09 service credit that a person claims or has claimed as a peace officer as authorized by sec. 4, 10 ch. 27, SLA 1983. 11 * Sec. 3. This Act takes effect July 1, 2002.
