01 "An Act relating to providing alcoholic beverages to a person under 21 years of age."                                   
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 04.16.051(d) is amended to read:                                                                  
04            (d)  A person acting with criminal negligence who violates this section is guilty                            
05       of a class C felony if                                                                                            
06                 (1)  [,] within the five years preceding the violation, the person has                              
07       been previously convicted under                                                                                   
08                      (A) [(1)]  this section; or                                                                    
09                      (B) [(2)]  a law or ordinance of this or another jurisdiction with                             
10            elements substantially similar to this section; or                                                       
11                 (2)  the person under 21 years of age who receives the alcoholic                                    
12       beverage injures or causes the death of another person and the injury or death                                
13       occurs while the person under 21 years of age was under the influence of an                                   
14       alcoholic beverage received in violation of this section.
