01 "An Act relating to prescription drug benefits under a group health care insurance                                      
02 plan."                                                                                                                  
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 21.54 is amended by adding a new section to read:                                                 
05            Sec. 21.54.155.  Prescription drug benefits.  A health care insurance plan                                 
06       sold in the group market that provides prescription drug benefits may not impose                                  
07                 (1)  a higher copayment amount or lower supply limit for a prescription                                 
08       drug purchased from a pharmacy in this state than the copayment amount or supply                                  
09       limit imposed for a prescription drug purchased by mail order;                                                    
10                 (2)  a penalty against a pharmacist if the penalty results from the                                     
11       pharmacist's accurately filling a prescription for which the pharmacist received written                          
12       or electronic approval from the health care insurance plan administrator; or                                      
13                 (3)  a supply limit for a prescription if the supply limit is lower than the                            
14       supply limit described in the prescription.
