00 HOUSE BILL NO. 221 01 "An Act making a capital appropriation to the Department of Education and Early 02 Development for public school facilities that is financed from the proceeds of revenue 03 bonds issued by the Northern Tobacco Securitization Corporation; making 04 appropriations to the Department of Transportation and Public Facilities for public 05 transportation projects and public harbor facility projects, issuance costs, and 06 capitalized interest that are financed from the proceeds from the sale of certificates of 07 participation in financing leases; and providing for an effective date." 08 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 09 * Section 1. PUBLIC SCHOOL FACILITIES. The sum of $127,270,151 is appropriated 10 to the Department of Education and Early Development for the financing of construction and 11 major maintenance grants under AS 14.11 for public schools from the proceeds of the bonds 12 described in sec. 5(a) of this Act that are issued by the Northern Tobacco Securitization 13 Corporation, and is allocated among the projects in the amounts set out below:

LAPSE PROVISION. The appropriations made in secs. 1 - 3 of this Act are not 19 one-year appropriations and lapse as provided in AS 37.25.020. 20 * Sec. 5. CONTINGENT EFFECT. (a) Section 1 of this Act takes effect only if a bill is 21 passed by the Twenty-Second Alaska State Legislature and is enacted into law that authorizes 22 the commissioner of revenue to sell to the Northern Tobacco Securitization Corporation the 23 right to receive a part of the revenue derived from the settlement of State of Alaska v. Philip 24 Morris, Incorporated, et al., No. 1JU-97-915 CI (Alaska Super. 1997) and authorizes the 25 Northern Tobacco Securitization Corporation to issue bonds that are to be repaid from the 26 revenue derived from the settlement. 27 (b) Section 2 of this Act takes effect only if a bill is passed by the Twenty-Second 28 Alaska State Legislature and is enacted into law that allows the state bond committee to issue 29 certificates of participation for state transportation projects. 30 (c) Section 3 of this Act takes effect only if a bill is passed by the Twenty-Second 31 Alaska State Legislature and is enacted into law that allows the state bond committee to issue

01 certificates of participation for public harbor facility projects. 02 * Sec. 6. If, under sec. 5 of this Act, this Act takes effect, it takes effect July 1, 2001.
