00 HOUSE BILL NO. 201 01 "An Act prohibiting certain persons who sell or serve alcohol from consuming alcoholic 02 beverages during hours of employment." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 04.16 is amended by adding a new section to read: 05 Sec. 04.16.085. Consumption by person serving or selling prohibited. (a) 06 Except as provided in this subsection, a person employed to sell or serve alcoholic 07 beverages may not, during hours of employment, consume alcoholic beverages. This 08 subsection does not apply to a person who in response to a customer request provides 09 wine-tasting or beer-tasting services for wine or beer being served to a customer on 10 the licensed premises. 11 (b) A person who violates this section is upon conviction guilty of 12 (1) a violation and shall be fined $100, if the person has not been 13 previously convicted under this section; 14 (2) a class A misdemeanor, if the person has been previously convicted

01 under this section. 02 (c) In addition to the penalty under (b) of this section, a person who is 03 convicted of violating this section and who has been previously convicted may not sell 04 or serve an alcoholic beverage on licensed premises. 05 (d) In this section, "previously convicted" means having been convicted under 06 this section within the five years preceding the current conviction. 07 * Sec. 2. AS 04.16.180(a) is amended to read: 08 (a) Except as provided in AS 04.11.015, AS 04.16.025, AS 04.16.050(b), 09 04.16.051, 04.16.085, 04.16.200 - 04.16.210, and AS 04.21.065, a person who violates 10 a provision of this title or a regulation adopted by the board is guilty, upon conviction, 11 of a class A misdemeanor. Each violation is a separate offense.
