01 "An Act relating to motor vehicle air pollution control programs."                                                      
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 46.14.400(i) is amended to read:                                                                  
04            (i)  If a municipality or a local air quality district administering a program                               
05       under this section requires emissions inspection for a motor vehicle,                                             
06                 (1)  emission inspection may not be required more than once every two                               
07       years; and                                                                                                    
08                 (2)  a person who operates a motor vehicle that has modified                                        
09       emissions parts may not be considered in violation of emissions requirements                                  
10       imposed under this section if the motor vehicle has emission levels that are at or                            
11       below standards imposed by law.                                                                               
12    * Sec. 2.  AS 46.14.510(e) is amended to read:                                                                     
13            (e)  If the department adopts regulations requiring emissions inspection for a                               
14       motor vehicle,                                                                                                    
15                 (1)  the department may not require that the vehicle be inspected more                          

01       than once every two years; and                                                                                
02                 (2)  a person who operates a motor vehicle that has modified                                        
03       emissions parts may not be considered in violation of emissions requirements                                  
04       imposed under this section if the motor vehicle has emission levels that are at or                            
05       below standards imposed by law.
