00 HOUSE BILL NO. 143 01 "An Act relating to the deoxyribonucleic acid (DNA) identification registration system." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 44.41.035(b) is amended to read: 04 (b) The Department of Public Safety shall collect for inclusion into the DNA 05 registration system a blood sample, oral sample, or both, from (1) a person convicted 06 of burglary or a crime against a person, and (2) a minor 16 years of age or older, 07 adjudicated as a delinquent for an act that would be burglary or a crime against a 08 person if committed by an adult. The DNA identification registration system consists 09 of the blood or oral samples drawn under this section, any DNA or other blood 10 grouping tests done on those samples, and the identification data related to the samples 11 or tests. Except as provided in (c)(3) of this section, blood [BLOOD] samples and 12 oral samples from persons not subject to testing under this section, and test or 13 identification data related to those samples, may not be entered into, or made a part of, 14 the DNA identification registration system. 15 * Sec. 2. AS 44.41.035(c) is amended to read:

01 (c) The Department of Public Safety may [PROVIDE] 02 (1) provide DNA analysis services to law enforcement agencies 03 throughout the state; [AND] 04 (2) provide assistance to law enforcement officials and prosecutors in 05 the preparation and utilization of DNA evidence for presentation in court; and 06 (3) provide for the inclusion in the DNA registration system of 07 samples, DNA or blood grouping tests, or identification data derived from 08 samples from missing persons, unidentified human remains, or relatives of 09 missing persons if the department finds that inclusion of the material or data 10 may benefit law enforcement or may likely lead to the solution of a crime or the 11 identification of an unidentified or missing person.
