00 SENATE CS FOR CS FOR HOUSE BILL NO. 65(HES) am S 01 "An Act relating to a new optional group of persons eligible for medical assistance who 02 require treatment for breast or cervical cancer; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 05 to read: 06 ADDITIONAL PERSONS ELIGIBLE FOR MEDICAL ASSISTANCE. (a) In 07 addition to the other persons listed under AS 47.07.020(b), persons who have been diagnosed 08 with breast or cervical cancer and who are eligible for coverage under 42 U.S.C. 09 1396a(a)(10)(A)(ii)(XVIII) are eligible under AS 47.07.020(b) for medical assistance, subject 10 to other provisions of AS 47.07.020. 11 (b) It is the intent of the legislature that not more than $175,800 of general fund 12 money be spent on services under (a) of this section for fiscal year 2002 and that not more 13 than $189,500 of general fund money be spent on services under (a) of this section for fiscal 14 year 2003.

01 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 02 read: 03 REPORT TO THE LEGISLATURE. The Department of Health and Social Services 04 shall report to the legislature by the 30th day of the Second Regular Session of the Twenty- 05 Second Alaska State Legislature and by the 30th day of the First Regular Session of the 06 Twenty-Third Alaska State Legislature on the following matters: 07 (1) the environmental, behavioral, or genetic factors that have been associated 08 with the onset of breast or cervical cancer in peer-reviewed clinical studies published in 09 periodical medical literature that have postulated an association between one or more of these 10 factors and an increase in the incidence of breast or cervical cancer; 11 (2) summary information from the Alaska Cancer Registry and other Alaska- 12 specific sources available to the department regarding risk factors for breast and cervical 13 cancer; 14 (3) recommendations, if any, about behavioral actions that may reduce the 15 occurrence or likelihood of these types of breast or cervical cancers; and 16 (4) to the extent that the information is available to the department in the 17 billings submitted for assistance under sec. 1 of this Act, the cost per person paid for by the 18 state under sec. 1 of this Act during the fiscal year preceding the date of the report and the 19 total medical costs per person for the fiscal year preceding the date of the report, whether paid 20 for by the state or not; the information provided in the department's report under this 21 paragraph shall be provided separately for each person who received assistance under sec. 1 22 of this Act, but the information shall be presented in a manner that does not allow 23 identification of the person. 24 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 25 read: 26 EMERGENCY REGULATIONS AUTHORIZED. In order to ensure that persons 27 described in sec. 1(a) of this Act receive essential, life-saving medical care, the Department of 28 Health and Social Services may adopt emergency regulations under AS 44.62.250 to 29 implement sec. 1(a) of this Act. 30 * Sec. 4. This Act is repealed two years after the effective date of this Act. 31 * Sec. 5. This Act takes effect immediately under AS 01.10.070(c).
