00SENATE BILL NO. 259 01 "An Act relating to criminal impersonation." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 11.46.570(a) is amended to read: 04  (a) A person commits the crime of criminal impersonation if the person 05  (1) assumes a false identity and does an act in the assumed character 06 with intent to commit a crime or to defraud; [OR] 07  (2) pretends to be a representative of some person or organization and 08 does an act in the pretended capacity with intent to commit a crime or to defraud ; 09 or 10  (3) possesses, without lawful authority, an identification card or 11 device belonging to another or a false identification card or device with the intent 12 to commit a crime or to defraud . 13 * Sec. 2. AS 11.46.570 is amended by adding new subsections to read: 14  (c) In (a)(3) of this section, the fact that the defendant possessed, without

01 lawful authority, two or more identification cards or devices of other persons, two or 02 more false identification cards or devices, or any combination of identification cards 03 or devices of other persons and false identification cards or devices totaling two or 04 more, is prima facie evidence that the defendant intended to commit an unlawful 05 activity. 06  (d) In this section, "identification card or device" includes a driver's license, 07 birth certificate, passport, hunting or fishing license, social security card, or other 08 device that purports to provide proof of identity of a person.
