00SENATE BILL NO. 146 01 "An Act relating to the amount and disposition of the commercial fishing license 02 fee and to the fishermen's fund; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. LEGISLATIVE INTENT. It is the intent of the legislature that nothing in this 05 Act either destroys a valid existing dedication of the proceeds of a state tax or license or 06 creates a new dedication of the proceeds of a state tax or license. 07 * Sec. 2. AS 16.05.110(a) is amended to read: 08  (a) The fish and game fund shall be made up of 09  (1) the following money and other money the legislature appropriates, 10 which shall be deposited and retained in the fund until expended: 11  (A) [(1)] money received from the sale of state sport fishing, 12 hunting, and trapping licenses, tags, and special permits, waterfowl 13 conservation tags purchased by hunters, and anadromous salmon tags purchased 14 by fishermen;

01  (B) [(2)] proceeds received from the sale of furs, skins, and 02 specimens taken by predator hunters and other employees; 03  (C) [(3)] money received in settlement of a claim or loss caused 04 by damage to the fish and game resources of the state; 05  (D) [(4)] money received from a federal, state, or other 06 governmental unit, or from a private donor for fish and game purposes; 07  (E) [(5)] interest earned upon money in the fund that is 08 described in this paragraph ; 09  (F) [(6)] money from any other source ; 10  (2) money that is required under law to be deposited into the fund 11 pending appropriation by the legislature for any public purpose, including 12 proceeds from the sale of commercial fishing licenses under AS 16.05.480 . 13 * Sec. 3. AS 16.05.480(a) is amended to read: 14  (a) A person engaged in commercial fishing shall obtain a commercial fishing 15 license. The fee for the license is $60 [$30] for residents [,] and $125 [$90] for 16 nonresidents. Except for those that [WHICH] are also entry or interim-use permits, 17 all commercial fishing licenses are nontransferable. The commercial fishing license 18 shall be retained in the possession of the licensee, readily accessible for inspection at 19 all times. No more than one fee may be charged annually against a person. For the 20 purposes of this section, "commercial fishing license" includes entry permits and 21 interim-use permits issued under AS 16.43 and crewmember fishing licenses. 22 * Sec. 4. AS 16.05.480 is amended by adding a new subsection to read: 23  (e) Except as provided under AS 16.05.470 and AS 23.35.060, fees collected 24 from the sale of commercial fishing licenses under this section shall be deposited into 25 the fish and game fund. 26 * Sec. 5. AS 23.35.060(a) is amended to read: 27  (a) There is created a fund, designated as the "fishermen's fund." The 28 Department of Revenue is the custodian of the fund and the Department of Labor shall 29 administer it. The fund shall be composed of 36 [60] percent of the money derived 30 by the state from all commercial fishermen's licenses and money appropriated to carry 31 out the purpose of this chapter.
