01 "An Act relating to the sale of the Matanuska Maid Dairy and Mt. McKinley                                               
02 Meat and Sausage Plant; and providing for an effective date."                                                           
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1.  SALE OF THE MATANUSKA MAID DAIRY AND MT. McKINLEY                                                    
05 MEAT AND SAUSAGE PLANT.  (a)  The governor shall issue by October 1, 1999, a request                                    
06 for proposals to purchase the Matanuska Maid Dairy and a request for proposals to purchase                              
07 the Mt. McKinley Meat and Sausage Plant.  The request for proposals must include all other                              
08 assets of the dairy or meat and sausage plant that are necessary or convenient for the operation                        
09 of either business.                                                                                                     
10  (b)  By October 1, 2001, the governor shall enter into an agreement to sell Matanuska                                  
11 Maid Dairy and Mt. McKinley Meat and Sausage Plant to the most responsive offeror who                                   
12 agrees to purchase the dairy or meat and sausage plant for an amount that exceeds either the                            
13 fair market value of the dairy or meat and sausage plant and the assets of the dairy or meat                            
14 and sausage plant that are necessary or convenient for the operation of the dairy or meat and                           

01 sausage plant, or the amount that the state has expended to obtain, maintain, and subsidize the                         
02 dairy or meat and sausage plant.                                                                                        
03  (c)  Matanuska Maid Dairy or Mt. McKinley Meat and Sausage Plant may not enter                                         
04 into a contract or other agreement that has the effect or purpose of substantially diminishing                          
05 the value or marketability of the dairy or meat and sausage plant.                                                      
06  (d)  The governor shall contract for preparation of a report on the fair market value                                  
07 of the Matanuska Maid Dairy and Mt. McKinley Meat and Sausage Plant and all other assets                                
08 of the dairy and meat and sausage plant that are necessary or convenient for the operation of                           
09 the dairy and meat and sausage plant by a qualified appraiser.  The results of the appraisal                            
10 shall be submitted to the legislature by the 10th legislative day of the Second Session of the                          
11 Twenty-First Alaska State Legislature.  A contract for the appraisal under this section is                              
12 exempt from AS 36.30.                                                                                                   
13  (e)  The governor shall report to the legislature by the 10th legislative day of the                                   
14 Second Session of the Twenty-First Alaska State Legislature regarding the procedures                                    
15 established for and the progress toward the sale of the Matanuska Maid Dairy and Mt.                                    
16 McKinley Meat and Sausage Plant as mandated by this Act.                                                                
17  (f)  The governor shall adopt regulations under AS 44.62 to implement this Act.                                        
18  (g)  The sale of the Matanuska Maid Dairy or Mt. McKinley Meat and Sausage Plant                                       
19 under this Act is not subject to AS 36.30.                                                                              
20    * Sec. 2.  This Act takes effect immediately under AS 01.10.070(c).
