00SENATE BILL NO. 98 am H 01 "An Act relating to teacher tenure." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 14.20.150(d) is amended to read: 04  (d) A teacher who has acquired tenure in a school district in the state and who 05 loses tenure in the district because of a break in service may reacquire [ACQUIRE] 06 tenure in that school district [OR ANOTHER SCHOOL DISTRICT] under this 07 subsection if the break in service was not the result of a dismissal under AS 14.20.170 08 or nonretention under AS 14.20.175 and did not last longer than one year. A break 09 in service that begins on or after the last day of a school district's instructional days 10 for a school year but before the first instructional day of the next school year will be 11 considered to have lasted no longer than one year if the teacher is employed on the 12 first instructional day of the school year that begins more than 12 but not more than 13 16 months after the beginning of the break in service. A previously tenured teacher 14 reacquires [ACQUIRES] tenure in the [A] school district under this subsection when

01 the teacher 02  (1) possesses a valid teaching certificate that authorizes the teacher to 03 be employed as a certificated teacher or as an administrator under regulations adopted 04 by the department; 05  (2) has been employed as a teacher in the district continuously for one 06 full school year after a break in service that does not exceed the time limits set out in 07 this subsection; 08  (3) receives, under the district's evaluation system, an acceptable 09 evaluation from the district; and 10  (4) on or before October 15 of the school year, 11  (A) accepts a contract for employment as a teacher in the 12 district for a second consecutive school year; and 13  (B) performs a day of teaching services in the district during 14 that school year. 15 * Sec. 2. AS 14.20.150(e) is amended by adding a new subsection to read: 16  (e) Notwithstanding (a) of this section, a teacher who has acquired tenure in 17 a school district who moves to a new school district acquires tenure in the new school 18 district on the first instructional day of the third year of employment in the new school 19 district if 20  (1) the teacher otherwise meets the qualifications for tenure set out in 21 (a) of this section; and 22  (2) the break in service meets the requirements of (d) of this section.
