00CS FOR SENATE BILL NO. 32(FIN) 01 "An Act making and amending appropriations and reappropriations; making and 02 amending appropriations under art. IX, sec. 17(c), Constitution of the State of 03 Alaska, from the constitutional budget reserve fund; and providing for an 04 effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. ALASKA CLEAN WATER FUND. The sum of $9,649,500 is appropriated 07 to the Alaska clean water fund (AS 46.03.032) for the Alaska clean water loan program from 08 the following sources: 09 General fund match $ 1,608,300 10 Federal receipts 8,041,200 11 * Sec. 2. ALASKA DRINKING WATER FUND. The sum of $8,956,600 is appropriated 12 to the Alaska drinking water fund (AS 46.03.036) for the Alaska drinking water loan program 13 from the following sources: 14 General fund match $ 1,492,800

01 Federal receipts 7,463,800 02 * Sec. 3. ALASKA INDUSTRIAL DEVELOPMENT AND EXPORT AUTHORITY. The 03 sum of $18,000,000 from the available unrestricted cash in the Alaska Industrial Development 04 and Export Authority revolving fund (AS 44.88.060) is anticipated to be transferred to the 05 general fund as directed by the Alaska Industrial Development and Export Authority. The 06 transferred money shall be deposited in the general fund when received during fiscal year 07 2000. 08 * Sec. 4. CAPITAL PROJECT MATCHING GRANT PROGRAMS. (a) The sum of 09 $13,150,000 is appropriated from corporate receipts of the Alaska Housing Finance 10 Corporation to the municipal capital project matching grant fund (AS 37.06.010(b)) in the 11 Department of Administration to provide grants to municipalities under the municipal capital 12 project matching grant program. 13 (b) The sum of $1,850,000 is appropriated from corporate receipts of the Alaska 14 Housing Finance Corporation to the unincorporated community capital project matching grant 15 fund (AS 37.06.020(b)) in the Department of Community and Regional Affairs to provide 16 grants to unincorporated communities under the unincorporated community capital project 17 matching grant program. 18 (c) An amount equal to the interest earned on money in the individual grant accounts 19 in the municipal capital project matching grant fund (AS 37.06.010(b)) and the unincorporated 20 community capital project matching grant fund (AS 37.06.020(b)) is appropriated from the 21 general fund to the respective funds. The interest is calculated using the average percentage 22 interest rate received by other accounts in the state's general investment fund that received 23 interest during fiscal year 1999. The appropriations made by this subsection are allocated pro 24 rata to each individual grant account based on the balance of the account on the close of 25 business on June 30, 1999. 26 * Sec. 5. CAPITAL PROJECT MATCHING GRANTS FOR MUNICIPALITIES. (a) 27 Subject to the conditions set out in (b) of this section, the sum of $1,438,819 is appropriated 28 from the appropriate individual grant accounts in the municipal capital project matching grant 29 fund (AS 37.06.010) to the Department of Administration for payment as grants under 30 AS 37.06.010 to the following municipalities in the amounts and for the purposes stated: 31 Akhiok Community facilities and equipment $ 30,899

FEDERAL AND OTHER PROGRAM RECEIPTS. Federal or other program 09 receipts as defined in AS 37.05.146 that exceed the amounts appropriated by this Act are 10 appropriated conditioned upon compliance with the program review provisions of 11 AS 37.07.080(h). 12 * Sec. 8. RURAL ELECTRIFICATION REVOLVING LOAN FUND. Notwithstanding 13 AS 42.45.020(g), the balance of the rural electrification revolving loan fund (AS 42.45.020) 14 on June 30, 1999, is appropriated to the Department of Community and Regional Affairs for 15 the electrical emergencies program. 16 * Sec. 9. KODIAK LAUNCH COMPLEX. (a) Subject to (b) of this section, the balance 17 of the earnings reserve of the Alaska science and technology endowment (AS 37.17.020(a)), 18 not to exceed $6,000,000, is appropriated from the earnings reserve to the Alaska Science and 19 Technology Foundation for payment as a grant under AS 37.17.090(k)(1) to the Alaska 20 Aerospace Development Corporation for completion of construction and the initial startup 21 costs of the Kodiak Launch Complex and for the commercialization of the facility. 22 (b) The appropriation made by (a) of this section is contingent on 23 (1) enactment in 1999 of an amendment of AS 37.17.090(k) to permit a grant 24 of $6,000,000; and 25 (2) approval of the board of directors of the Alaska Science and Technology 26 Foundation. 27 * Sec. 10. FISH AND GAME FUND. That portion of the revenue derived from the sale 28 of crewmember fishing licenses during the fiscal year ending June 30, 2000, that is not 29 appropriated for payment of compensation to agents under AS 16.05.470 and that is not 30 deposited into the fishermen's fund under AS 23.35.060 is appropriated to the fish and game 31 fund (AS 16.05.100).

01 * Sec. 11. FISH AND GAME FUNDING SOURCE. The source of the "other funds" 02 funding source for the appropriation made by sec. 31, ch. 137, SLA 1998, page 32, line 20 03 (Administration and Support - $6,088,500) is amended to delete $60,000 from Interagency 04 receipts and to add $60,000 from federal receipts. 05 * Sec. 12. DEPARTMENT OF NATURAL RESOURCES. The unexpended and 06 unobligated balance of the appropriation made in sec. 9, ch. 139, SLA 1998 (DNR appraisal 07 of public school lands - $432,525) is reappropriated for the fiscal year ending June 30, 2000, 08 to the Department of Natural Resources for an appraisal of public school lands to determine 09 the fair market value of the public school trust land where the land was redesignated as 10 general grant land in 1978. 11 * Sec. 13. GRANT TO ARCTIC POWER. The sum of $250,000 is appropriated from 12 the general fund to the Department of Community and Regional Affairs for payment as a grant 13 under AS 37.05.316 to Arctic Power for education efforts to open the coastal plain of the 14 Arctic National Wildlife Refuge for oil and gas exploration and development. 15 * Sec. 14. KETCHIKAN TREATMENT FACILITY. The sum of $200,000 is appropriated 16 from statutory designated program receipts to the Department of Health and Social Services 17 for construction of a regional youth/residential diagnostic treatment facility in Ketchikan. 18 * Sec. 15. PIONEERS' HOMES AND DEPARTMENT OF COMMUNITY AND 19 REGIONAL AFFAIRS. Section 6(f), ch. 2, SLA 1999, is amended to read: 20  (f) The unexpended and unobligated corporate receipts balances of the 21 appropriations made in sec. 10, ch. 4, FSSLA 1994, page 7, lines 30 - 31 (federal 22 competitive grants/public housing - $7,076,000) and sec. 10, ch. 4, FSSLA 1994, 23 page 7, line 32 (federal competitive grants - $4,953,000) are reappropriated to the 24 Department of Administration for boiler system replacement at the Fairbanks 25 Pioneers' Home. The [, AND THE] unexpended and unobligated corporate receipts 26 balance, not to exceed $588,664 [$676,834], of the appropriation made in sec. 10, 27 ch. 4, FSSLA 1994, page 7, line 34 (other competitive grants - $1,300,000) is [ARE] 28 reappropriated to the Department of Administration for boiler system replacement at 29 the Fairbanks Pioneers' Home. The unexpended and unobligated corporate receipts 30 balance, after the reappropriation of up to $588,664 for boiler system replacement 31 made by this section, of the appropriation made in sec. 10, ch. 4, FSSLA 1994,

01 page 7, line 34 (other competitive grants - $1,300,000) is reappropriated to the 02 Department of Community and Regional Affairs for state match of federal funds 03 from the United States Department of Commerce. 04 * Sec. 16. The sum of $566,000 is appropriated from interagency receipts of the 05 Department of Environmental Conservation from federal nonpoint source pollution funds to 06 the following departments for operating costs for the fiscal year ending June 30, 2000, in the 07 amounts and for the purposes stated: 08 DEPARTMENT AND PURPOSE APPROPRIATION AMOUNT 09 Department of Natural Resources, $121,000 10 division of forestry, for monitoring 11 the Forest Practices Act 12 Department of Fish and Game, habitat 284,000 13 division, for monitoring Best Management 14 Practices in cooperation with the division 15 of forestry in the Department of Natural 16 Resources 17 Department of Natural Resources, division of 66,000 18 forestry, for Tanana River dynamics 19 Department of Fish and Game, habitat division, 40,000 20 for identification of fish utilization areas of the 21 Tanana River in cooperation with the division 22 of forestry in the Department of Natural Resources 23 Department of Fish and Game, habitat division, 55,000 24 Best Management Practices for road and 25 stream crossings in the Tongass National 26 Forest. 27 * Sec. 17. HOPE COMMUNITY RESOURCES. The sum of $25,000 is appropriated from 28 the general fund to the Department of Health and Social Services for payment as a grant under 29 AS 37.05.316 to Hope Community Resources for a fire suppression sprinkler system. 30 * Sec. 18. ALASKA CENTER FOR THE BLIND. The sum of $34,500 is appropriated 31 from the general fund to the Department of Health and Social Services for payment as a grant

01 under AS 37.05.316 to the Alaska Center for the Blind for a fire suppression sprinkler system. 02 * Sec. 19. EXXON VALDEZ OIL SPILL RESTORATION FUND. (a) The legislature 03 finds that 04 (1) as a result of the judgment entered by the United States District Court in 05 the criminal case United States of America v. Exxon Shipping Company and Exxon 06 Corporation, No. A90-015 CR, the state received $50,000,000 in restitution "to be used by the 07 State of Alaska . . . exclusively for restoration projects, within the State of Alaska, relating 08 to the 'Exxon Valdez' oil spill"; 09 (2) the money received by the state in restitution is held in the "Exxon Valdez 10 oil spill restoration fund," established by the Department of Revenue, to implement the 11 judgment; and 12 (3) the appropriation in (b) of this section is made in order to achieve the 13 purposes in the court's restitution order. 14 (b) The sum of $215,000 is appropriated from the income accrued during the fiscal 15 year ending June 30, 2000, on the Exxon Valdez oil spill restoration fund described in (a) of 16 this section to the Department of Environmental Conservation for the Cordova Mile 17 landfill 17 construction. 18 * Sec. 20. DEPARTMENT OF ADMINISTRATION. The sum of $288,000 is appropriated 19 from the general fund to the Department of Administration in the following amounts and for 20 the following programs for increased operating costs for the fiscal year ending June 30, 1999: 21 PROGRAM APPROPRIATION AMOUNT 22 Alaska Oil and Gas Conservation $ 188,000 23 Commission 24 Longevity bonus grant program 100,000 25 * Sec. 21. CONSTITUTIONAL BUDGET RESERVE FUND. (a) Section 42(b), ch. 139, 26 SLA 1998, as amended by sec. 22, ch. 2, SLA 1999, is amended to read: 27  (b) If the unrestricted state revenue available for appropriation in fiscal year 28 1999 is insufficient to cover the general fund appropriations made for fiscal year 1999, 29 the amount necessary to balance revenue and general fund appropriations, not to 30 exceed $1,100,000,000 [$900,000,001], is appropriated to the general fund from the 31 budget reserve fund (art. IX, sec. 17, Constitution of the State of Alaska).

01 (b) If the unrestricted state revenue available for appropriation in fiscal year 2000 is 02 insufficient to cover the general fund appropriations made for fiscal year 2000, the amount 03 necessary to balance revenue and general fund appropriations, not to exceed $1,007,000,000, 04 is appropriated to the general fund from the budget reserve fund (art. IX, sec. 17, Constitution 05 of the State of Alaska). 06 * Sec. 22. (a) Section 53, ch. 100, SLA 1997, as amended by sec. 7, ch. 139, SLA 1998, 07 is amended to read: 08  Sec. 53. AMERICAN RED CROSS GRANT LAPSE EXTENSION. That 09 portion of the appropriation made in sec. 30, ch. 117, SLA 1996, page 39, line 8 10 (Department of Military and Veterans' Affairs for disaster planning and control - 11 $3,161,000) that was awarded by the department as a grant to the American Red Cross 12 lapses into the funds from which appropriated on June 30, 2000 [1999]. 13 (b) Section 8, ch. 139, SLA 1998, is amended to read: 14  Sec. 8. LAPSE EXTENSION OF FY 1998 AMERICAN RED CROSS 15 GRANT. That portion of the appropriation made in sec. 39, ch. 98, SLA 1997, page 16 41, line 17 (Department of Military and Veterans' Affairs for disaster planning and 17 control - $3,341,600) that was awarded by the department as a grant to the American 18 Red Cross lapses into the funds from which appropriated on June 30, 2000 [1999]. 19 * Sec. 23. MISCELLANEOUS CLAIMS. The following amounts are appropriated from 20 the general fund to the following departments to pay miscellaneous claims and stale-dated 21 warrants for the fiscal year ending June 30, 1999: 22 DEPARTMENT APPROPRIATION 23 Administration $ 2,423.29 24 Fish and Game 1,952.90 25 Law 1,189.20 26 * Sec. 24. EXPENSES RELATED TO THE BP AMOCO-ARCO MERGER. (a) The sum 27 of $100,000 is appropriated from the general fund to the Department of Law for costs 28 associated with the proposed BP Amoco - ARCO merger for the fiscal years ending June 30, 29 1999, and June 30, 2000. 30 (b) The sum of $100,000 is appropriated from the general fund to the Alaska 31 Legislative Council for costs associated with the proposed BP Amoco - ARCO merger for the

01 fiscal years ending June 30, 1999, and June 30, 2000. 02 * Sec. 25. DEPARTMENT OF LAW SUBMERGED LANDS LITIGATION. The sum of 03 $30,000 is appropriated from the general fund to the Department of Law for the costs of the 04 Glacier Bay/Tongass submerged lands quiet title litigation for the fiscal year ending June 30, 05 1999. 06 * Sec. 26. FEDERAL AND OTHER PROGRAM RECEIPTS FOR FISCAL YEAR 1999 07 CAPITAL BUDGET. Federal or other program receipts as defined in AS 37.05.146 that 08 exceed the amounts appropriated by ch. 139, SLA 1998, are appropriated conditioned upon 09 compliance with the program review provisions of AS 37.07.080(h). 10 * Sec. 27. DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES. (a) 11 If sec. 35 of this Act has not taken effect under sec. 31(b) of this Act before July 1, 2000, sec. 12 35 of this Act is repealed on July 1, 2000. 13 (b) If sec. 37 of this Act has not taken effect under sec. 31(c) before July 1, 2000, 14 sec. 37 of this Act is repealed on July 1, 2000. 15 (c) If sec. 39 of this Act has not taken effect under sec. 31(d) before July 1, 2000, 16 sec. 39 of this Act is repealed on July 1, 2000. 17 * Sec. 28. LAPSE PROVISIONS. (a) The appropriations made by secs. 1, 2, 4, and 10 18 of this Act are for capitalization of funds and do not lapse under AS 37.25.010. 19 (b) The appropriations made by secs. 8, 9, 13 - 15, and 17 - 19, are for capital 20 projects and lapse under AS 37.25.020. 21 * Sec. 29. CONSTITUTIONAL BUDGET RESERVE VOTING NOTICE. The 22 appropriations made and amended by sec. 21 of this Act are made under art. IX, sec. 17(c), 23 Constitution of the State of Alaska. 24 * Sec. 30. RETROACTIVITY. Section 26 of this Act is retroactive to July 1, 1998. 25 * Sec. 31. EFFECTIVE DATES. (a) Sections 11, 12, 15, 20, 21(a), 22 - 26 and 34 - 36 26 of this Act take effect immediately under AS 01.10.070(c). 27 (b) Section 35 of this Act takes effect on the day after the Anchorage Metropolitan 28 Area Transportation Study policy committee authorizes the commissioner of transportation and 29 public facilities to publish public notice of a proposal to amend the Statewide Transportation 30 Improvement Plan to incorporate all the projects included in sec. 35 of this Act. The 31 commissioner of transportation and public facilities shall immediately notify the lieutenant

01 governor and the revisor of statutes when the notice is published. 02 (c) Section 37 of this Act takes effect on the day after the commissioner of 03 transportation and public facilities publishes public notice of a proposal to amend the 04 Statewide Transportation Improvement Plan to incorporate the projects included in sec. 37 of 05 this Act. The commissioner of transportation and public facilities shall immediately notify the 06 lieutenant governor and the revisor of statutes when the notice is published. 07 (d) Section 39 of this Act takes effect on the day after the commissioner of 08 transportation and public facilities publishes public notice of a proposal to amend the 09 Statewide Transportation Improvement Plan to incorporate the projects included in sec. 39 of 10 this Act. The commissioner of transportation and public facilities shall immediately notify the 11 lieutenant governor and the revisor of statutes when the notice is published. 12 * Sec. 32.
