CSHJR 2(JUD): Proposing amendments to the Constitution of the State of Alaska relating to the duration of regular sessions of the legislature and to a biennial state budget.

00CS FOR HOUSE JOINT RESOLUTION NO. 2(JUD) 01 Proposing amendments to the Constitution of the State of Alaska relating to the 02 duration of regular sessions of the legislature and to a biennial state budget. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. Article II, sec. 8, Constitution of the State of Alaska, is amended to read: 05  Section 8. Regular Sessions. The legislature shall convene in regular session 06 each year on the fourth Monday in January, but the month and day may be changed 07 by law. The legislature shall adjourn from regular session no later than one hundred 08 twenty consecutive calendar days from the date it convenes during each odd- 09 numbered year, and, during each even-numbered year, a regular session may last no 10 longer than sixty consecutive calendar days, except that any [A] regular session may be 11 extended once for up to ten consecutive calendar days. An extension of the regular session 12 requires the affirmative vote of at least two-thirds of the membership of each house of the 13 legislature. The legislature shall adopt as part of the uniform rules of procedure deadlines for 14 scheduling session work not inconsistent with provisions controlling the length of the session.

01 * Sec. 2. Article IX, sec. 12, Constitution of the State of Alaska, is amended to read: 02  Section 12. Budget. (a) During each odd-numbered fiscal year, the [THE] 03 governor shall submit to the legislature, at a time fixed by law, a budget for the next 04 two fiscal years [YEAR] setting forth all proposed expenditures and anticipated 05 income of all departments, offices, and agencies of the State. The governor, at the 06 same time, shall submit a general appropriation bill to authorize the proposed 07 expenditures in the biennial State budget , and a bill or bills covering 08 recommendations in the budget for new or additional revenues. 09 * Sec. 3. Article IX, sec. 12, Constitution of the State of Alaska, is amended by adding a 10 new subsection to read: 11  (b) The legislature shall pass a general appropriation bill to implement the 12 State budget for a two-year period that begins with each even-numbered fiscal year. 13 The legislature may pass an appropriation bill that amends or supplements the biennial 14 State budget at any time. 15 * Sec. 4. Article XV, Constitution of the State of Alaska, is amended by adding a new 16 section to read: 17  Section 30. Application of Biennial State Budget Amendments. The 2000 18 amendments relating to a biennial State budget (art. IX, sec. 12) apply to the State 19 budget for fiscal years 2002 and 2003 and thereafter. Section 12 of Article IX, as it 20 read before the 2000 amendments, applies to the State budget for fiscal years up to and 21 including fiscal year 2001. 22 * Sec. 5. The amendments proposed by this resolution shall be placed before the voters of 23 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 24 State of Alaska, and the election laws of the state.
