00CS FOR HOUSE BILL NO. 445(RLS) 01 "An Act relating to a rural school construction and planned maintenance pilot 02 program; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. The uncodified law of the State of Alaska is amended by adding a new 05 section to read: 06 LEGISLATIVE FINDING AND INTENT. (a) The legislature finds that traditional 07 procurement techniques may be improved by addressing ongoing maintenance and 08 maintenance training. 09 (b) It is the intent of the legislature to 10 (1) collaborate with the Department of Education and Early Development to 11 meet capital improvement project needs and create a pilot project program combining private 12 sector development techniques with public procurement; and 13 (2) create a program that can lead to efficacy in design, firm price proposals, 14 and prompt, timely project completion on ongoing maintenance and maintenance training.

01 * Sec. 2. AS 14.11.020 is amended by adding a new subsection to read: 02  (e) This section does not apply to a school construction project described under 03 AS 14.11.030. 04 * Sec. 3. AS 14.11 is amended by adding a new section to read: 05  Sec. 14.11.030. Rural school construction and planned maintenance pilot 06 program. (a) The department shall establish a rural school construction and planned 07 maintenance pilot program for the purpose of building educational facilities. 08  (b) The department shall implement the pilot program required in (a) of this 09 section by contracting with a private sector entity or entities selected through a request 10 for proposals process. In developing the request for proposals, the department shall 11 consult with the governing body of each regional educational attendance area in which 12 a rural school affected by the request for proposals is located. The request for 13 proposals required under this subsection must 14  (1) solicit proposals for development of at least one school construction 15 project, but not more than two-thirds of all school construction projects, funded for 16 construction in fiscal year 2001 and located within rural educational attendance areas; 17  (2) allow a responder to propose development of single or multiple 18 schools; and 19  (3) retain design professionals of record. 20  (c) Requests for proposals under this section must address the following 21 components: 22  (1) financial management; 23  (2) design methodologies; 24  (3) construction methodologies; 25  (4) a maintenance plan; 26  (5) a training plan; and 27  (6) local participation. 28  (d) Requests for proposals issued by the department under this section must 29 use a qualifications-based selection process. Under this subsection the criteria for 30 evaluation and selection must be based on 31  (1) proposed methodologies to reduce capital construction costs,

01 establish timely completion schedules, and provide a facility maintenance plan for a 02 period of time following completion; and 03  (2) qualifications and experience to accomplish the criteria set out in 04 (1) of this subsection. 05 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section 06 to read: 07 EVALUATION. The Department of Education and Early Development shall evaluate 08 the school development projects described in AS 14.11.030, enacted by sec. 3 of this Act, 09 compare them against other projects procured in a conventional manner, and annually make 10 recommendations to the Alaska State Legislature as to whether the rural school construction 11 and planned maintenance pilot program shall continue. 12 * Sec. 5. This Act takes effect immediately under AS 01.10.070(c).
