00CS FOR HOUSE BILL NO. 439(STA) 01 "An Act relating to the compensation of certain public employees and officials 02 not covered by collective bargaining agreements; and providing for an effective 03 date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 39.20.010 is amended by adding new subsections to read: 06  (b) Effective July 1, 2001, the amount set out in (a) of this section is increased 07 by two percent. 08  (c) Effective July 1, 2002, the amount set out in (a) of this section, as 09 increased under (b) of this section, is increased by three percent. 10 * Sec. 2. AS 39.20.030 is amended by adding new subsections to read: 11  (b) Effective July 1, 2001, the amount set out in (a) of this section is increased 12 by two percent. 13  (c) Effective July 1, 2002, the amount set out in (a) of this section, as 14 increased under (b) of this section, is increased by three percent.

AS 39.27.011(e) is repealed and reenacted to read: 05  (e) Effective July 1, 2001, the amounts set out in the salary schedule contained 06 in (a) of this section are increased by two percent. 07 * Sec. 5. AS 39.27.011(f) is repealed and reenacted to read: 08  (f) Effective July 1, 2002, the amounts set out in the salary schedule contained 09 in (a) of this section, as increased under (e) of this section, are increased by three 10 percent. 11 * Sec. 6. The uncodified law of the State of Alaska is amended by adding a new section 12 to read: 13 LUMP SUM PAYMENT FOR EMPLOYEES OF THE LEGISLATIVE BRANCH 14 AND CERTAIN EMPLOYEES OF THE EXECUTIVE BRANCH. (a) Subject to an 15 appropriation for fiscal year 2001 for that purpose, and except as provided in (b) of this 16 section, classified and partially exempt employees in the executive branch of the state 17 government who are not members of a collective bargaining unit established under the 18 authority of AS 23.40.070 - 23.40.260 (Public Employment Relations Act), and employees of 19 the legislature under AS 24.10 and AS 24.20, employed and in pay status on July 1, 2000, are 20 entitled to receive a lump sum payment of up to $1,200, prorated at $50 for each pay period 21 that the employee was in pay status in fiscal year 2000. The lump sum will be reduced by 22 amounts necessary to pay mandatory employee and employer deductions. 23 (b) Notwithstanding the requirements of (a) of this section, employees of the 24 legislature who would otherwise be entitled to payment under (a) of this section but who were 25 not employed or in pay status on July 1, 2000, because their employment was limited to the 26 legislative session, are entitled to receive the prorated lump sum payment provided in (a) of 27 this section. 28 * Sec. 7. The uncodified law of the State of Alaska is amended by adding a new section 29 to read: 30 LUMP SUM PAYMENT FOR CERTAIN ELECTED AND APPOINTED OFFICIALS, 31 MAGISTRATES, AND JUDICIAL OFFICERS. Justices of the supreme court, judges of the

01 court of appeals and the superior and district courts, magistrates, the governor, and the 02 lieutenant governor are entitled to receive the lump sum payment provided for in sec. 6 of this 03 Act, subject to the conditions set out in that section. 04 * Sec. 8. The uncodified law of the State of Alaska is amended by adding a new section 05 to read: 06 SALARY ADJUSTMENTS AND LUMP SUM PAYMENT FOR CERTAIN EXEMPT 07 EMPLOYEES OF THE EXECUTIVE BRANCH. Permanent and temporary employees in the 08 executive branch of the state government, other than the governor and lieutenant governor, 09 who are in the exempt service under AS 39.25, are not members of a collective bargaining 10 unit established under AS 23.40.070 - 23.40.260 (Public Employment Relations Act ), and are 11 not otherwise covered by AS 39.27.011(a), are entitled to receive 12 (1) salary adjustments comparable to those received by classified and partially 13 exempt employees of the executive branch under AS 39.27.011(e) and (f), as repealed and 14 reenacted by secs. 4 and 5 of this Act; and 15 (2) the lump sum payment provided for in sec. 6 of this Act, subject to the 16 conditions set out in that section. 17 * Sec. 9. The uncodified law of the State of Alaska is amended by adding a new section 18 to read: 19 SALARY ADJUSTMENTS AND LUMP SUM PAYMENT FOR CERTAIN 20 EMPLOYEES OF THE JUDICIAL BRANCH. (a) Permanent and temporary employees in 21 the judicial branch of the state government, other than magistrates and judicial officers, who 22 are not members of a collective bargaining unit established under AS 23.40.070 - 23.40.260 23 (Public Employment Relations Act) are entitled to receive 24 (1) salary adjustments comparable to those received by classified and partially 25 exempt employees of the executive branch under AS 39.27.011(e) and (f), as repealed and 26 reenacted by secs. 4 and 5 of this Act; and 27 (2) the lump sum payment provided for in sec. 6 of this Act, subject to the 28 conditions set out in that section. 29 (b) Justices of the supreme court, judges of the court of appeals and the superior and 30 district courts, and magistrates are entitled to receive salary adjustments provided for in secs. 31 4 and 5 of this Act, in accordance with AS 22.05.140(d), AS 22.07.090(c), AS 22.10.190(d),

01 and AS 22.15.220(b) and (e). 02 * Sec. 10. AS 39.27.011(g) is repealed. 03 * Sec. 11. This Act takes effect July 1, 2000.
