00HOUSE BILL NO. 431 01 "An Act relating to the facilities constituting a school for purposes of public 02 school funding; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.17.905 is amended to read: 05  Sec. 14.17.905. Facilities constituting a school. For purposes of this chapter, 06 the determination of the number of schools in a district is subject to the following: 07  (1) a community with an ADM of at least 10, but not more than 100, 08 shall be counted as one school; 09  (2) a community with an ADM of at least 101, but not more than 450 10 [750], shall be counted as 11  (A) one elementary school, which includes those students in 12 grades kindergarten through six [6]; and 13  (B) one secondary school, which includes students in grades 14 seven [7] through 12;

01  (3) in a community with an ADM of greater than 450 [750], each 02 facility that is administered as a separate school shall be counted as one school, except 03 that each alternative school with an ADM of less than 200 shall be counted as a part 04 of the school in the district with the highest ADM. 05 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section 06 to read: 07 FUNDING BASED ON DEFINITION OF FACILITY CONSTITUTING A SCHOOL. 08 In addition to other amounts that the school district may receive under AS 14.17, if a school 09 district, on June 30, 1999, consisted of three separate schools located in one community, and 10 the district, in fiscal year 2000, has an ADM of at least 101, but not more than 750, then the 11 district is eligible to receive additional public school funding equal to a percentage of the 12 difference between the amount the district would be eligible to receive under AS 14.17.410 13 if each school in the district were counted as a separate school as described under 14 AS 14.17.905(3) and the amount the district is eligible to receive under AS 14.17.410 as a 15 district counted as having one elementary school and one secondary school under 16 AS 14.17.905(2) as follows: 17 (1) in fiscal year 2000, 75 percent of the difference; 18 (2) in fiscal year 2001, 50 percent of the difference; 19 (3) in fiscal year 2002, 25 percent of the difference. 20 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section 21 to read: 22 RETROACTIVITY. Section 2 of this Act is retroactive to July 1, 1999. 23 * Sec. 4. Section 1 of this Act takes effect July 1, 2002.
