00CS FOR HOUSE BILL NO. 360(FSH)                                                                                        
01 "An Act establishing the shore fisheries development lease program account and                                          
02 the timber receipts account; relating to the accounting for and appropriation of                                        
03 revenue from the state land disposal program, the shore fisheries development                                           
04 lease program, and the state timber disposal program; and providing for an                                              
05 effective date."                                                                                                        
06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
07    * Section 1.  AS 37.05.146(b)(4) is amended by adding new subparagraphs to read:                                   
08   (X)  state land disposal program (AS 38.04.022);                                                                    
09   (Y)  shore fisheries development lease program account                                                              
10 (AS 38.05.082(f));                                                                                                      
11   (Z)  timber receipts account (AS 38.05.110);                                                                        
12    * Sec. 2.  AS 38.04.022(a) is amended to read:                                                                     
13  (a)  The revenue from the [SALE OF] state land  disposal program  shall be                                          
14 deposited in  the  [A SPECIAL] state land disposal income  fund  [ACCOUNT] in the                                   

01 state  treasury.  On June 30 of each fiscal year, the portion of that fund that                                        
02 exceeds $5,000,000 shall be deposited in the state  general fund.  The legislature may                                 
03 appropriate money from the [SPECIAL] state land disposal income  fund  [ACCOUNT]                                      
04 for expenditure by the Department of Natural Resources for necessary costs incurred                                     
05 by the commissioner in the implementation of state land disposal programs authorized                                    
06 under this title  or for any other public purpose .                                                                   
07    * Sec. 3.  AS 38.05.082 is amended by adding a new subsection to read:                                             
08  (f)  The shore fisheries development lease program account is established in the                                      
09 state treasury.  The rents, fees, and other proceeds received by the department in                                      
10 connection with the issuance of shore fisheries development leases under this section                                   
11 shall be deposited into the account.  The legislature may appropriate money deposited                                   
12 into the account for the operation of the shore fisheries development lease program by                                  
13 the department or for any other public purpose.                                                                         
14    * Sec. 4.  AS 38.05.110 is amended by adding a new subsection to read:                                             
15  (b)  The timber receipts account is established in the state treasury.  The                                           
16 revenue from the sale of timber from state lands shall be deposited in the timber                                       
17 receipts account.  The legislature may appropriate money deposited into the timber                                      
18 receipts account for implementation of the state timber disposal program by the                                         
19 department or for any other public purpose.                                                                             
20    * Sec. 5.  This Act takes effect July 1, 2000.
