00HOUSE BILL NO. 252 01 "An Act relating to child support." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 25.27.060 is amended by adding a new subsection to read: 04 (e) Upon a showing by an obligor of good cause to believe that previous 05 support payments made by the obligor for support of a child were not spent for the 06 needs of the child, a court may order the custodian of the child to submit 07 documentation to the court or to the court's designee of the manner in which the 08 custodian spends future support payments. 09 * Sec. 2. AS 25.27 is amended by adding a new section to read: 10 Sec. 25.27.257. Disposition of overpayments. (a) If the right to child 11 support payments has not been assigned under AS 47.27.040 and an obligor has 12 overpaid money owed under a support order or duty of support because of a 13 modification or error in the amount owed, the agency shall 14 (1) apply the amount of the overpayment to reduce the amount of any
01 support arrearages or debts owed to the obligee; and 02 (2) if an overpayment exists after the reduction of any arrearage or 03 debt, reduce the amount of the support remitted to the obligee by an amount no greater 04 than 20 percent of the current monthly support obligation and remit this amount to the 05 obligor until the overpayment is reduced to zero.
