01 "An Act relating to municipal regulation of the storage of building materials on                                        
02 certain lots."                                                                                                          
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1.  AS 29.10.200 is amended by adding a new paragraph to read:                                           
05   (59)  AS 29.35.142 (regulation of the storage of building materials)                                                 
06    * Sec. 2.  AS 29.35 is amended by adding a new section to read:                                                    
07  Sec. 29.35.142.  Regulation of the storage of building materials.  (a)  A                                           
08 municipality may not restrict the right to store building materials on a lot if                                         
09   (1)  the period of storage does not exceed six months;                                                               
10   (2)  the lot on which the building materials are stored is at least one                                              
11 acre in size; and                                                                                                       
12   (3)  the stored building materials are not visible from a road used by the                                           
13 public.                                                                                                                 
14  (b)  This section applies to home rule and general law municipalities.
