00HOUSE BILL NO. 223 01 "An Act repealing a prohibition on the issuance of a restaurant or eating place 02 license when the license applicant is a representative or owner of a certain type 03 of business holding an alcoholic beverage license." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 04.11.450(b) is amended to read: 06 (b) A person who is a representative or owner of a wholesale business, 07 brewery, winery, bottling works, or distillery may not be issued, solely or together with 08 others, a beverage dispensary license [, A RESTAURANT OR EATING PLACE 09 LICENSE,] or package store license. A holder of a beverage dispensary license may 10 be issued a brewpub license, subject to the provisions of AS 04.11.135. [THE 11 PROHIBITION AGAINST ISSUANCE OF A RESTAURANT OR EATING PLACE 12 LICENSE IMPOSED UNDER THIS SUBSECTION DOES NOT APPLY TO A 13 RESTAURANT OR EATING PLACE LICENSE ISSUED ON OR BEFORE 14 OCTOBER 1, 1996 OR A RESTAURANT OR EATING PLACE LICENSE ISSUED
