00CS FOR HOUSE BILL NO. 185(L&C)                                                                                        
01 "An Act exempting certain small water utilities from regulation by the Alaska                                           
02 Public Utilities Commission; and providing for an effective date."                                                      
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1.  AS 42.05.711(e) is amended to read:                                                                  
05  (e)  Notwithstanding any other provisions of this chapter, any electric , water,                                    
06 or telephone utility that does not gross $50,000 annually is exempt from regulation                                     
07 under this chapter unless the subscribers petition the commission for regulation under                                  
08 AS 42.05.712(h).                                                                                                        
09    * Sec. 2.  This Act does not apply to utilities with open dockets before the Alaska Public                         
10 Utilities Commission until those dockets are closed.                                                                    
11    * Sec. 3.  This Act takes effect July 1, 1999.
