00HOUSE BILL NO. 113 01 "An Act relating to a program of postsecondary education for high school 02 students." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.30 is amended by adding new sections to read: 05 Article 10. Postsecondary Enrollment Options Program. 06  Sec. 14.30.760. Postsecondary enrollment program. (a) A student enrolled 07 in the 11th or 12th grade in a school district or otherwise receiving a comparable 11th 08 or 12th grade education as described in AS 14.30.010(b)(1) or (10) - (12) may also 09 apply for enrollment in nonsectarian courses at a postsecondary institution. If a 10 postsecondary institution accepts a secondary school student, the institution shall send 11 written notice to the student, the student's school district, and the department within 12 10 days after acceptance. The notice must include the student's courses and hours of 13 enrollment. If a student enrolls for postsecondary credit, the institution shall notify the 14 student about paying for tuition in the customary manner used by the institution.

01  (b) A school district shall make counseling services regarding the risks and 02 possible consequences of enrolling in postsecondary courses available to students and 03 a student's parents or guardian. Upon request, the department shall provide assistance 04 to a school district in developing counseling programs. 05  (c) A student may not enroll in postsecondary courses for secondary credit for 06 more than the equivalent of one school year. A student who has graduated from high 07 school may not participate in the postsecondary program established under this section, 08 but a student who has completed course requirements for graduation but has not 09 received a diploma may participate. 10  (d) Students who have graduated from high school may receive enrollment 11 priority over secondary school students in a postsecondary institution. A 12 postsecondary institution may provide program information but may not recruit or 13 solicit secondary school student participation. A governing body may not prohibit a 14 secondary school student from participating in extracurricular activities if the 15 prohibition results from enrollment in a postsecondary course as described under this 16 section. 17  Sec. 14.30.770. Calculation of academic credit. (a) Upon enrollment in a 18 postsecondary course, a secondary school student shall elect to receive either secondary 19 school credit or postsecondary school credit. A student who enrolls in more than one 20 course shall make the election on a course-by-course basis. A secondary school 21 student who audits a postsecondary course may not receive secondary school credit for 22 that course. 23  (b) The department shall determine the secondary school academic credit to 24 be granted to a student who successfully completes a postsecondary course. As 25 determined by the department, a governing body shall grant academic credit towards 26 graduation requirements and subject area requirements. The completion of a 27 postsecondary course must be included in the student's academic record. 28  (c) If a student leaves secondary school and enrolls in the same postsecondary 29 institution that the student attended while enrolled in secondary school, any course 30 successfully completed for secondary school credit shall also be credited for 31 postsecondary graduation requirements. A postsecondary institution may not charge

01 a tuition fee for the award of credit described in this subsection. 02  Sec. 14.30.780. Funding for postsecondary institutions. (a) Subject to 03 appropriation, the department shall make payments required under this section for 04 postsecondary courses taken for secondary school credit. The department may not 05 make payments for courses taken only for postsecondary credit or for a course from 06 which a student withdraws during the first 14 days of the quarter or semester. 07  (b) A postsecondary institution that enrolls a secondary school student shall 08 receive the following amounts: 09  (1) for an institution granting quarter credit, the reimbursement per 10 credit hour is equal to 88 percent of the per student amount represented by that student 11 in that school district under AS 14.17, multiplied by 1.3 and divided by 45; or 12  (2) for an institution granting semester credit, the reimbursement per 13 credit hour is equal to 88 percent of the per student amount represented by that student 14 in that school district under AS 14.17, multiplied by 1.3 and divided by 30. 15  (c) The department shall pay the amounts described under (b) of this section 16 within 30 days after receiving initial enrollment information for each quarter or 17 semester. Any changes in enrollment information shall be reported by the 18 postsecondary institution at the time for reporting enrollment information in the 19 following quarter or semester. If the department determines that an overpayment has 20 occurred, the institution shall promptly remit the amount overpaid to the department. 21  Sec. 14.30.790. Funding for school districts. Subject to appropriation and 22 in addition to funding received under AS 14.17, the department shall make payments 23 to school districts for a student who is 20 years of age or older who is enrolled in a 24 postsecondary institution in order to meet secondary school graduation requirements 25 as follows: 26  (1) for a student not attending classes in the school district, the school 27 district shall receive 12 percent of the per student amount represented by that student 28 in that school district under AS 14.17, multiplied by 65 percent, and that product 29 multiplied by 1.3; or 30  (2) for a student attending classes in the school district on a part-time 31 basis, the school district shall receive the per student amount represented by a student

01 of school age attending the same classes in that school district under AS 14.17, 02 multiplied by 65 percent, that product multiplied by 1.3, and that product multiplied 03 by the ratio of the total number of hours the student is in attendance in secondary 04 school to 1020 hours. 05  Sec. 14.30.800. Prohibited financial aid and fees. (a) A secondary school 06 student enrolled in a postsecondary course for secondary school credit may not apply 07 for a student loan under AS 14.43. 08  (b) A postsecondary institution that receives reimbursement under 09 AS 14.30.780 may not charge that student for fees, textbooks, materials, or support 10 services except for items that become the property of the student. This subsection 11 does not apply to a student taking a course for postsecondary credit. 12  Sec. 14.30.810. Definitions. In AS 14.30.760 - 14.30.810, 13  (1) "district" has the meaning given in AS 14.17.990; 14  (2) "postsecondary institution" means a public or private nonsectarian 15 school, college, or university primarily offering academic, vocational or technical 16 education to a person who has completed secondary school and that is located in this 17 state.
