00HOUSE BILL NO. 74 01 "An Act relating to salary caps and to the power to transfer certain positions 02 to the classified service and entitlement to longevity increments for certain state 03 officials." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 39.20.080(b) is amended to read: 06  (b) The monthly salary of a deputy head or an assistant head of a principal 07 executive department of the state is not less than Step A nor more than Step F, Range 08 21, [RANGE 28] of the salary schedule in AS 39.27.011(a) for Juneau, Alaska. 09 * Sec. 2. AS 39.20.080 is amended by adding new subsections to read: 10  (d) The monthly salary of a director of a division within a principal executive 11 department of the state is not less than Step A nor more than Step F, Range 21, of the 12 salary schedule in AS 39.27.011(a) for Juneau, Alaska. 13  (e) The monthly salary of an employee in the Office of the Governor, the 14 office of the lieutenant governor, or the office of the commissioner of a principal

01 department in the executive branch of state government who is a member of the 02 exempt or partially exempt service may not exceed Step F, Range 21, of the salary 03 schedule in AS 39.27.011(a) for Juneau, Alaska. This subsection does not apply to 04  (1) one chief of staff, one press secretary, one legislative director, three 05 regional directors, one director of the Washington, D.C. office, three Washington, D.C. 06 associate directors, one administrative services director, one director of the office of 07 management and budget, one governmental coordination director, one human rights 08 commission director, and one director of the office of equal employment opportunity 09 in the Office of the Governor; 10  (2) the chief of staff and the director of the division of elections in the 11 office of the lieutenant governor; 12  (3) the Department of Law; 13  (4) the University of Alaska. 14 * Sec. 3. AS 39.25.130(c) is amended to read: 15  (c) The personnel board, upon written recommendation of the commissioner 16 of administration, may extend the classified service to include any position in the 17 partially exempt service other than a position listed in AS 39.20.080(e)(1) or (2) . 18 * Sec. 4. AS 39.27.022 is amended by adding a new subsection to read: 19  (e) This section does not apply to deputy commissioners, assistant 20 commissioners, or division directors within a principal executive department of the 21 state. 22 * Sec. 5. Work performed on or after the effective date of this Act by a deputy 23 commissioner, assistant commissioner, division director of a principal executive department 24 of the state, or a person described in AS 39.20.080(e), enacted by sec. 2 of this Act, is subject 25 to the provisions of this Act.
