01 "An Act relating to land use regulation in residential zones by home rule                                               
02 municipalities."                                                                                                        
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1.  AS 29.35.180(b) is amended to read:                                                                  
05  (b)  A home rule borough shall provide for planning, platting, and land use                                           
06 regulation.   A home rule borough shall provide for at least one public hearing                                        
07 before property that is zoned or otherwise designated in a land use plan                                                
08 exclusively or primarily for residential use may be used for a different purpose.                                       
09 A home rule borough may not allow gravel to be extracted and transported from                                           
10 property that is zoned or designated exclusively or primarily for residential use,                                      
11 except that a home rule borough may permit the owner of a lot or a tract of land                                        
12 consisting of several lots to extract gravel located on the lot or tract and use it at                                  
13 a different location on the same lot or tract.
