00HOUSE BILL NO. 44 01 "An Act authorizing animal control agencies and humane societies to purchase, 02 possess, and use certain drugs for euthanizing dogs and cats." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 08.80 is amended by adding a new section to read: 05  Sec. 08.80.035. Permits for use of drugs to euthanize dogs and cats. (a) 06 The board shall adopt regulations that provide for the issuance of a permit that 07 authorizes the purchase, possession, and use of sodium pentobarbital and sodium 08 pentobarbital with lidocaine by a municipal or village animal-control agency or 09 humane society for the purpose of euthanizing injured, sick, or abandoned dogs or cats 10 in the lawful possession of the agency or society. The regulations must include 11 guidelines for proper storage and handling of sodium pentobarbital and sodium 12 pentobarbital with lidocaine and other provisions that may be necessary to ensure that 13 the drugs are used solely for the purpose authorized under this subsection. The 14 application fee for a permit under this subsection is $50, and the biennial renewal fee

01 is $50. 02  (b) A municipal or village animal-control agency or humane society may apply 03 to the board for a permit to purchase, possess, and use sodium pentobarbital or sodium 04 pentobarbital with lidocaine as authorized under (a) of this section. Upon certification 05 by the board that the applicant meets the qualifications that are established in 06 regulations adopted under (a) of this section, the department shall issue the permit. 07  (c) The board may revoke or suspend a permit issued under this section on a 08 determination that the permittee used sodium pentobarbital or sodium pentobarbital 09 with lidocaine for a purpose other than authorized under this section or if the permittee 10 fails to follow the regulations of the board regarding proper storage and handling of 11 the drugs. 12  (d) A person with a permit issued under this section shall also comply with 13 applicable federal laws. 14 * Sec. 2. AS 08.98.120(a) is amended to read: 15  (a) A person may not practice veterinary medicine, surgery, or dentistry unless 16 the person is licensed as a veterinarian under this chapter or has a temporary permit 17 issued under AS 08.98.186, except that a person may perform functions authorized by 18  (1) regulation of the board if the person is licensed as a veterinary 19 technician ; and 20  (2) a permit issued under AS 08.80.035 if the person is employed 21 by or is a volunteer with an animal-control agency or humane society that 22 has a permit issued under AS 08.80.035 .
