00HOUSE BILL NO. 35                                                                                                     
01 "An Act relating to the crime of failure to stop at the direction of a peace                                            
02 officer; and providing for an effective date."                                                                          
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1.  AS 28.35.182(a) is amended to read:                                                                  
05  (a)  A person commits the offense of failure to stop at the direction of a peace                                      
06 officer in the first degree if the person violates (b) of this section, and, during the                                 
07 commission of that offense, the person                                                                                  
08    (1)   violates a traffic law or commits another crime ; and                                                      
09   (2)  exposes a peace officer or another person to a risk of serious                                                  
10 physical injury   [.  IN THIS SUBSECTION,                                                                              
11    (1)  "CRIME" HAS THE MEANING GIVEN IN AS 11.81.900;                                                                 
12    (2)  "TRAFFIC LAW" HAS THE MEANING GIVEN IN                                                                         
13 AS 28.15.261].                                                                                                          
14    * Sec. 2.  AS 28.35.182(d) is amended by adding new paragraphs to read:                                            



01   (3)  "crime" has the meaning given in AS 11.81.900;                                                                  
02   (4)  "serious physical injury" has the meaning given in AS 11.81.900;                                                
03   (5)  "traffic law" has the meaning given in AS 28.15.261.                                                            
04    * Sec. 3.  Sections 1 and 2 of this Act are retroactive to September 23, 1998.                                     
05    * Sec. 4.  This Act takes effect immediately under AS 01.10.070(c).
