00HOUSE BILL NO. 33 01 "An Act relating to bounty hunters and to capturing criminal suspects or 02 fugitives." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 18.65 is amended by adding a new section to article 6 to read: 05  Sec. 18.65.505. Bounty hunters must notify law enforcement agencies 06 before attempting to capture suspect or fugitive. (a) A person may not 07  (1) act as a bounty hunter in this state unless the person first notifies 08 the nearest post of the Alaska state troopers and the municipal police department, if 09 any, where the person will be attempting to capture a suspect or fugitive of the 10 person's name and address, the name and address of the suspect or fugitive sought, and 11 the time when the person will attempt to capture the suspect or fugitive; or 12  (2) capture or attempt to capture in this state a suspect or fugitive 13 unless the person first notifies the nearest post of the Alaska state troopers and the 14 municipal police department, if any, where the person will be attempting to capture the

01 suspect or fugitive of the person's name and address, the name and address of the 02 suspect or fugitive sought, and the time when the person will attempt to capture the 03 suspect or fugitive. 04  (b) This section does not apply to 05  (1) a peace officer or correctional officer acting within the scope and 06 authority of the officer's employment and appointment; or 07  (2) a person who comes to the aid of a peace officer or correctional 08 officer capturing or attempting to capture a suspect or fugitive. 09  (c) It is an affirmative defense to a prosecution under (a)(2) of this section that 10 the person was not seeking and did not receive any monetary or other reward, gain, 11 or remuneration for capturing or attempting to capture the suspect or fugitive. In this 12 subsection, "affirmative defense" has the meaning given in AS 11.81.900. 13  (d) In this section, "bounty hunter" means a person who, as a business or 14 profession, or otherwise for monetary or other reward, gain, or remuneration, captures 15 or attempts to capture criminal suspects or fugitives from the law. 16  (e) A person who violates this section is guilty of a class A misdemeanor and 17 may be punished as provided in AS 12.55.
