00HOUSE BILL NO. 15 01 "An Act relating to disclosure of information about certain children; and 02 amending Rule 22, Alaska Child in Need of Aid Rules." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 47.10.092 is amended by adding a new subsection to read: 05  (d) Notwithstanding AS 47.10.090 and 47.10.093, a current or previous foster 06 parent of a child subject to a proceeding under AS 47.10.010 - 47.10.142 may disclose 07 confidential or privileged information about the child, including information that has 08 been lawfully obtained from agency or court files, to the governor, the lieutenant 09 governor, a legislator, the ombudsman appointed under AS 24.55, the attorney general, 10 and the commissioners of health and social services, administration, or public safety, 11 or an employee of these persons, for review or use in their official capacities. The 12 department shall disclose additional confidential or privileged information about the 13 child and make copies of all documents in the file about the child available for 14 inspection to these state officials or employees for review or use in their official

01 capacities upon request of the official or employee and submission of written evidence 02 that a current or previous foster parent of the child has requested the official's 03 assistance in the case as part of the official's duties. A person to whom disclosure is 04 made under this subsection may not disclose confidential or privileged information 05 about the child to a person not authorized to receive it. 06 * Sec. 2. COURT RULE. AS 47.10.092(d), enacted by sec. 1 of this Act, has the effect 07 of amending Rule 22, Alaska Child in Need of Aid Rules, by providing an exception to the 08 confidentiality of information pertaining to certain children.
