01 "An Act relating to collective bargaining agreements and arbitration awards of                                          
02 class (a)(1) municipal employees."                                                                                      
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1.  AS 23.40.215(a) is amended to read:                                                                  
05  (a)  Except as provided in (d) of this section, the  [THE] monetary terms of                                        
06 any agreement entered into under AS 23.40.070 - 23.40.260 are subject to funding                                        
07 through legislative appropriation.                                                                                      
08    * Sec. 2.  AS 23.40.215 is amended by adding a new subsection to read:                                             
09  (d)  An agreement negotiated by a municipal public employer and a bargaining                                          
10 organization representing employees of the municipality who are members of the class                                    
11 in AS 23.40.200(a)(1) that has been approved by vote of the governing body of the                                       
12 municipality and by the bargaining organization constitutes a contract between the                                      
13 municipality and the bargaining organization.  The monetary terms of an arbitration                                     
14 award made under AS 23.40.200(b) as a result of an impasse or deadlock in collective                                    

01 bargaining between a municipal public employer and employees of the municipality                                        
02 who are members of the class in AS 23.40.200(a)(1) shall be treated as a contract                                       
03 between the municipality and the bargaining organization representing the employees.                                    
04    * Sec. 3.  This Act applies to agreements reached on or after the effective date of this Act                       
05 and to arbitration awards in cases of deadlocks or impasses submitted to arbitration under                              
06 AS 23.40.200(b) on or after the effective date of this Act.
