SJR 3: Proposing an amendment to the Constitution of the State of Alaska limiting the rights of prisoners to those required under the Constitution of the United States.

00SENATE JOINT RESOLUTION NO. 3 01 Proposing an amendment to the Constitution of the State of Alaska limiting the 02 rights of prisoners to those required under the Constitution of the United States. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. Article I, sec. 12, Constitution of the State of Alaska, is amended to read: 05  Section 12. Criminal Administration. Excessive bail shall not be required, 06 nor excessive fines imposed, nor cruel and unusual punishments inflicted. The rights 07 of prisoners and protection against infliction of cruel and unusual punishments 08 shall be limited to those protections and rights required under the Constitution 09 of the United States. Criminal administration shall be based upon the following: the 10 need for protecting the public, community condemnation of the offender, the rights of 11 victims of crimes, restitution from the offender, and the principle of reformation. 12 * Sec. 2. The amendment proposed by this resolution shall be placed before the voters of 13 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 14 State of Alaska, and the election laws of the state.
