01 "An Act relating to the provision of electric utility service."                                                         
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
03    * Section 1.  AS 42.05.221 is amended by adding a new subsection to read:                                          
04  (g)  A certificated electric utility that allows other certificated electrical utilities                              
05 to have open access to its own electrical system facilities may request the commission                                  
06 to issue orders necessary for the electric utility to be able immediately to use the                                    
07 facilities of another electric utility for the provision of retail electric service in the area                         
08 certificated to the other electric utility if the other electric utility has more than 30                               
09 customers for each mile of distribution line.  The commission shall issue the orders                                    
10 requested within 10 days after receiving the request.  A request under this subsection                                  
11 may include a request for interim refundable tariffs for distribution access services.
